2-1-1 ELECTED OFFICERS.

(A) The elected officers of the city shall be a Mayor and six Council members. The Mayor and Council members shall constitute the Council and shall continue in office until assumption of duties of office by their duly elected successors.

(B) The term of office of the Mayor shall be four years.

(C) Council members shall serve four year overlapping terms in the manner provided by state statute.

2-1-2 CORPORATE POWERS.

The corporate powers of the city shall be vested in the Council and shall be exercised only as directed or authorized by law. All powers of the Council shall be exercised by ordinance, resolution, order or motion.

2-1-3 DUTIES OF OFFICE.

The Mayor and members of the Council shall assume the duties of office at the first regular meeting of the Council in June following the date of the general election at which, or effective as of the date of which, the Mayor and Council members were elected.

2-1-4 VACANCIES IN COUNCIL.

Vacancies on the Council shall be filled as provided in the Charter.

2-1-5 COMPENSATION.

(A) Compensation of Mayor. The Mayor of the City of Goodyear will be compensated for his or her duties at the rate of $1,916.67 per month for the term of office beginning June, 2007 and terms thereafter.

(B) Compensation of Vice Mayor. The Vice Mayor of the City of Goodyear shall be compensated for his or her duties at the rate of $1,041.67 per month for the term of office beginning June, 2007 and terms thereafter.

(C) Compensation of Council members. Each member of the City Council not serving as Mayor or Vice Mayor shall be compensated for his or her duties at the rate of $766.67 per month, for the term of office beginning June, 2007 and terms thereafter.

(D) Implementation.

(1) This section shall be implemented on June 1, 2007 with regard to the salaries of the following:

(a) The Mayor for terms beginning in June 2007 and thereafter, whether such Mayor is newly elected or re elected;

(b) The Vice Mayor for terms beginning in June 2007 and thereafter, whether the Vice Mayor is newly elected or re elected;

(c) Any Council member for a term beginning in June 2007 or thereafter, whether newly elected or re elected.

(2) This section shall be implemented on June 1, 2007 with regard to salaries of Council members whose terms begin in June 2007 or thereafter, whether newly elected or re elected. Until such time as this new compensation schedule is implemented as herein provided with regard to any Mayor, Vice Mayor or Council member, he or she shall be compensated at the rates in effect before passage of this section. In no event shall any salary be increased during the remainder of the current term of the Mayor, Vice Mayor or Council members serving at the time of adoption of this section.

(E) City Council benefits.

(1) The Mayor and members of the Council shall be eligible to participate in the city benefit plans available to other city employees, including but not limited to health insurance, life insurance, medical flex spending accounts, and vision plans at the same contribution rates as full-time employees.

(2) For the purposes of this provision, BENEFIT PLANS shall not include the Elected Officials’ Retirement Plan.

2-1-6 OATH OF OFFICE.

Immediately prior to assumption of the duties of office, the Mayor and each Council member shall, in public, take and subscribe to the oath of office.

2-1-7 BOND.

Prior to taking office, the Mayor and every Council member shall execute and file an official bond, enforceable against the principal and his or her sureties, conditioned on the due and faithful performance of his or her official duties, payable to the state and to and for the use and benefit of the city or any person who may be injured or aggrieved by the wrongful act or default of such officer in his or her official capacity. A person so injured or aggrieved may bring suit on such bond under provisions identical to those contained in A.R.S. § 38-260. Bonds shall be in such sum as shall be provided by resolution, and the premium for such bonds shall be paid by the city.

2-1-8 FINANCIAL DISCLOSURE STATEMENT.

The Mayor and each Council member shall file a financial disclosure statement in a form and with such information as provided by resolution of the Council and pursuant to state law.
