3-1-1 CITY MANAGER.
(A) The office of City Manager shall be filled as provided by the Charter, and the City Manager shall have such powers and duties as are assigned by the Charter, together with such other powers and duties not inconsistent with the Charter or other law as may be assigned by the Council. The City Manager shall serve at the pleasure of the Council, but may be removed from office only as provided by the Charter.
(B) The City Manager shall have the authority to employ one or more assistants. An Assistant City Manager shall have such duties as may be delegated by the City Manager, and one such assistant shall be delegated to serve as Acting City Manager in the temporary absence of the City Manager. An Assistant City Manager shall serve at the pleasure of the City Manager.

3-1-2 CITY ATTORNEY.
The office of City Attorney shall be filled as provided by the Charter, and the City Attorney shall have such powers and duties as are assigned by the Charter, together with such other powers and duties not inconsistent with the Charter or other law as may be assigned by the Council. The City Attorney shall serve at the pleasure of the Council and may be removed by a majority vote of the members of the Council then holding office.

3-1-3 CITY MAGISTRATE.
Until such time as the provisions of Charter, Art. XI, §§ 1 et seq. are implemented, the Council shall employ a City Magistrate who shall have the powers and duties assigned by Chapter 6 of this code and by statute generally. The City Magistrate shall be appointed by the Council and shall serve at the pleasure of the Council for a term of two years and may be reappointed.

3-1-4 CITY CLERK.
A City Clerk shall be appointed by the City Manager and shall have the powers and duties provided by the Charter, together with the duties imposed on the City Clerk by statute and such other duties and powers as may be assigned by the Council or the City Manager not inconsistent with the Charter or other law.

3-1-5 DEPARTMENT HEADS.
(A) Pursuant to the authority granted by the Charter, there are created the following departments, each of which shall be under the immediate direction of a department head as set forth herein:
(1) City Clerk.
(2) City Manager.
(3) Community Development.
(4) Deleted.
(5) Economic Development.
(6) Engineering.
(7) Finance.
(8) Fire.
(9) Human Resources.
(10) Information and Technology Services.
(11) Legal Services.
(12) Parks and Recreation.
(13) Police.
(14) Public Works.
(B) The head of each department shall be appointed by and report to the City Manager. The City Manager shall advise the Council of each such appointment at the regular Council meeting next following such appointment. Department heads shall serve at the pleasure of the City Manager.

3-1-6 ADDITIONAL OFFICERS.
The Council may appoint and remove from time to time such other officers as it may deem necessary and that are not provided for in the Charter, this code or statute.

3-1-7 BOND.
The Council may, at its discretion, require that any officer of the city post a bond for faithful performance with such sureties as are acceptable to the Council. The bond shall be payable to the city, and the city shall pay all costs in connection therewith.

3-1-8 VACANCIES; DEPUTIES; HOLDING MORE THAN ONE OFFICE.
(A) A vacancy in any office not subject to Council appointment shall be filled by appointment of the City Manager.
(B) The powers and duties of any of the offices enumerated in § 3-1-5 may be performed by a deputy upon authorization of the City Manager.
(C) It shall be lawful for one person to hold more than one office, but such person shall be compensated only for one office to which he or she has been regularly appointed.

3-1-9 ADDITIONAL POWERS AND DUTIES.
In addition to any powers and duties prescribed in this code, each officer shall have such further powers, perform such further duties and hold such other offices as the Council may provide.
