12-9-1 DISTRIBUTION OF EFFLUENT.

(A) The city intends to distribute and deliver effluent to property owners who wish to use effluent for watering purposes permitted by law. This will be done on a first come first served basis to the extent effluent is available. Availability is subject to existing and future agreements made by the city.

(B) A person desiring to obtain effluent shall make application to the city on forms provided by the city and shall pay the rate as established by resolution of Council.

(C) The city shall have no obligation to install distribution lines to properties but may enter into contracts wherein the city and a potential effluent user agree to the construction of transmission and distribution lines upon some cost sharing arrangement or at the expense of the city or the user.

(D) Any effluent not contractually dedicated to a particular user may be made available by the city to a user at rates fixed by resolution of Council.

12-9-2 RATES.

The Council by way of resolution shall, from time to time, establish rates to be charged for effluent received from the city during each billing period and the fee for connection to the effluent delivery line.

12-9-3 BILLS, COLLECTION AND THE LIKE.

(A) Charges for effluent service will be billed periodically and shall be due and payable on the date indicated on the billing.

(B) In the event of untimely payment for effluent service, the city shall have the same rights to collect delinquent fees, to terminate service and to collect fees for discontinuance and reestablishment of service as applicable to water service accounts.

(C) The procedures for application for service and the making of a deposit, which are applicable in the case of establishing water service, shall be applicable to effluent service.

(D) The city shall have the right to terminate effluent service in the event effluent furnished by the city is used for any unlawful purpose; provided, however, that the user shall have the right to appeal any such termination of service in the same manner as provided for an appeal of termination of water service.
