13-5-1 Definitions

A.    Business Park means a group of one (1) or two (2) story buildings served by a common roadway system. Uses include research laboratories, limited incidental manufacturing within a business park campus and retail services that support primary business park uses.

B.    Commercial/Shopping Center means any facility that sells goods and services to the general public and other businesses. The retail/commercial category also applies to branch banks, child care, lodges and fraternal organizations.

C.    Housing Unit means one (1) or more rooms, or a portion of a room in a building, designed or intended to be used, or actually used, for occupancy by one (1) family for living and sleeping quarters and containing one (1) kitchen only, including a mobile home, but not hotel or motel units.

D.    Office/Institutional means any facility that provides offices for professionals, administrative functions, financial services (other than branch banks), and professional services. The office/institutional category also applies to hospitals, churches, schools and government buildings.

E.    Light Industrial means activities other than manufacturing including but not limited to printing plants, material-testing laboratories, trucking, recycling and food processing.

F.    Lodging means any establishment that offers temporary lodging in rooms for less than one (1) month (thirty (30) days), such as hotels or motels.

G.    Manufacturing refers to uses whose primary activity is the conversion of raw materials or parts into finished products. In addition to the actual production of goods, manufacturing facilities may have incidental office, warehouse and associated functions.

H.    Warehousing means any facility whose primary use is to warehouse, store or distribute goods, including self-storage facilities.

13-5-2 Parks and Recreation Development Fee

A.    There is hereby established a Parks and Recreation Development Fee.

B.    The Parks and Recreation Development Fee shall only be assessed against residential development.

C.    The Parks and Recreation Development Fee shall be assessed at the following rate:

D.    The Parks and Recreation Director shall be responsible for determining development fee credits pursuant to Oro Valley Town Code Section 13-2-5.

E.    The Parks and Recreation Development Fee may be adjusted on an annual basis in accordance with the Marshall Swift Valuation Service and upon public notice of the adjustment at least thirty (30) days in advance of the effective date.

13-5-3 Library Development Fee

A.    There is hereby established a Library Development Fee.

B.    The Library Development Fee shall only be assessed against residential development.

C.    The Library Development Fee shall be assessed at the following rate:

D.    The Town Manager, or designee, shall be responsible for determining Library Development Fee credits pursuant to Oro Valley Town Code Section 13-2-5.

E.    The Library Development Fee may be adjusted on an annual basis in accordance with the Marshall Swift Valuation Service upon public notice of the adjustment at least thirty (30) days in advance of the effective date.

13-5-4 Police Development Fee

A.    There is hereby established a Police Development Fee.

B.    The Police Development Fee shall be assessed against residential and commercial development.

C.    The Police Development Fee shall be assessed at the following rates:

13-5-5 General Government Development Fee

A.    There is hereby established a General Government Development Fee.

B.    The General Government Development Fee shall be assessed against residential and commercial development.

C.    The General Government Development Fee shall be assessed at the following rates:

13-5-6 Transportation Development Fee

A.    There is hereby established a Transportation Development Fee.

B.    The Transportation Development Fee shall be assessed against residential and commercial development.

C.    The Transportation Development Fee shall be assessed at the following rates:

D.    The Town Engineer shall be responsible for determining Transportation Development Fee credits pursuant to Oro Valley Town Code Section 13-2-5.

E.    The Transportation Development Fee may be adjusted on an annual basis in accordance with the Engineering News Record Construction and/or Materials Cost Index upon public notice of the adjustment at least thirty (30) days in advance of the effective date.
