RECREATION, MUSIC AND PARKS COMMISSION

2.12.010 Established — Membership — Terms.

A recreation, music and parks commission consisting of seven members is established for this city. One of the members of the commission shall be a member of, and selected by, the city council. The remaining members of the commission shall be appointed by the city council and must have resided in the city not less than one year prior to their appointments. The member of the commission selected from the city council shall serve until the thirtieth day of June after his/her appointment and until his/her successor is appointed and qualifies, or until he/she ceases to be a member of the city council, whichever occurs first. Terms of office for each of the other members of the commission hereafter appointed shall be four years, saving and excepting any appointed members may be removed by a vote of five members of the council. 2.12.020 Powers and duties.

The recreation, music and parks commission shall have the duty of serving in an advisory capacity to the city manager, city council and recreation director on all matters pertaining to public recreation, including the management, conduct and care of the parks and playgrounds in the city, cultural arts programs, and providing musical entertainment and programs by the municipal band and other musical organizations, and, in general, to study the needs of the city and the means of meeting such needs in connection with all such matters pertaining to public recreation, cultural arts, music and other entertainment.

The commission shall counsel with the recreation director and the city manager in connection with the preparation of the annual budget for the recreation department, including the parks of the city, and make recommendations with respect thereto to the city manager and city council.

The commission shall assist in the planning of a recreation and cultural arts programs for the inhabitants of the city and promote and stimulate public interest therein, and, to that end, solicit to the fullest possible extent the cooperation of special authorities and other public and private agencies interested therein.

The commission shall study present and future needs of the city with respect to recreation, music and park facilities, programs and events and make recommendations to the city council and city manager concerning the same. (Ord. 1545 NCS §1, 1983: Ord. 504 NCS §8: prior code §2.45.)

2.12.030 Officers — Generally.

The officers of the recreation, music and parks commission shall consist of a chairman, vice chairman and secretary. The officers shall be selected from among the membership of the commission and shall serve for a period ending on the thirtieth day of June after their selection, and until their successors are selected and qualify. 2.12.040 Duties of officers.

The chairman shall be the presiding officer at all meetings of the recreation, music and parks commission, and, in the case of his absence, the vice chairman shall preside at all such meetings. The secretary shall have the duty of recording the minutes of all meetings of the commission, indicating therein the members present, all actions taken by the commission and the vote taken on all matters acted upon by the commission. 2.12.050 Meetings generally.

The recreation, music and parks commission shall meet regularly once each month on a date to be selected by the commission. Special meetings of the commission may be called by the chairman and must be called by the chairman upon the written request of any four members of the commission. Written notice of all special meetings shall be mailed to each member at his last known address according to the records of the commission not less than twelve hours prior to such meeting. The notice of special meetings shall specify the purpose of the meeting and the time and place when it is to be held. All meetings of the commission may beheld in the council chambers in the city hall or any other place selected by vote of the members of the commission. 2.12.060 Vacancies.

Upon the death, resignation, disability to perform the duties of a member of the recreation, music and parks commission, or upon the loss of permanent residency from this city, or upon the failure to attend any meetings of the commission for three consecutive regular meetings, the council shall review and if found to be appropriate, declare the office of such member vacant and thereupon appoint some qualified person to fill such vacancy for the unexpired term of such member.
