18.30.010 Applicability.

These regulations shall apply to the following zones including:

A.    R-3, restricted multiple-family residential district;

B.    R-4, multiple-family residential district;

C.    R-3-G, garden multiple-family residential district. (Ord. 1368 § 1 (part), 2006: Ord. 1087 § 1 Exh. A (part), 1991)

18.30.020 Permitted uses.

A.    The following uses are permitted in R-3, R-3-G and R-4 Districts:

1.    Single-family dwellings and two-family dwellings in a single-family structure;

2.    Family care home for the aged;

3.    Accessory buildings;

4.    Home occupations, as defined in this title.

B.    The following use is permitted in R-3 and R-4 Districts:

1.    Multiple-family dwellings or apartment houses in a single structure.

C.    The following use is permitted in the R-3-G District:

1.    Multiple-family dwellings and apartment houses in a single structure and not exceeding six-family dwelling units. (Ord. 1368 § 1 (part), 2006: Ord. 1087 § 1 Exh. A (part), 1991)

18.30.030 Conditional uses.

The following uses shall be permitted in the R-3, R-3-G and R-4 Districts upon the granting of a use permit by the Zoning Administrator or the Planning Commission in accordance with the provisions of this title:

As a requirement of filing a conditional use permit, the applicant shall permit the posting of the property by the Planning Staff noticing neighbors of the development proposal. The notice shall be placed at least ten days prior to the public hearing. The sign shall not be moved or removed during the required posting period. (Ord. 1368 § 1 (part), 2006: Ord. 1087 § 1 Exh. 18.30.040 Development standards.

The following minimum and maximum requirements shall apply to all R-3, R-3-G and R-4 Districts:

C.    Building Regulations. In a survey of vacant and potentially redevelopable lots, the City of San Carlos found that there are three types of lots and lot sizes which naturally dictate a unique set of development constraints. Recognizing these constraints, the height and setback standards applicable to all multifamily zones have been structured by lot size and width as follows:

1. Lots Less Than 100 Feet in Width and/or 6,000 Square Feet or Less in Area; Interior or Corner Lots

For exterior side yards on lots with reversed frontage, the rear one-quarter of the exterior side yard shall not be less than the front yard required or existing on the lot adjoining said exterior yard (see Diagram for Section 18.24.040, Side Yards).

Height

Maximum height is thirty-five feet, maximum three stories (as defined in the Uniform Building Code).

Supplemental Standards

Parking design standards dictate a fairly rigid placement of parking and the driveway, either at grade or submerged. If at grade, building placement is somewhat dictated over parking spaces.

The dwelling units shall be oriented on the side of the lot which will cause the least impact to adjacent properties as determined by the Planning Director or his/her designated representative.

No garage or carport, the entrance of which faces any property line, shall be situated closer to such property line than eighteen feet or such greater distance as needed for accessibility.

Window or wall projections into side yards shall be set back at least five feet from either side property line. Chimneys may protrude no more than two feet into the side yard.

Orientation of outdoor living areas should be away from neighboring bedroom areas to promote privacy. Landscaping shall be implemented to screen views from the street and neighboring properties.

Balconies or outdoor living areas shall be screened to promote privacy and to reduce the visual impact of outdoor storage to neighboring properties and public rights-of-way (i.e., balcony railings shall be solid or semisolid, or balconies should be thoroughly screened/obscured by landscaping).

Off-street parking as regulated in the parking requirements chapter of this title (Chapter 18.140).

Open Space. A minimum amount of open space per dwelling unit shall be required as provided for in Section 18.116.160.

A trash and recycling enclosure or other appropriate waste provision shall be provided in an easily accessible location, sufficient to meet the demands of the size of development and shall be architecturally consistent with the building.

Residential Accessory Structures. The height of a residential accessory structure shall adhere to the requirements as outlined in Section 18.116.125.

The proposed project shall include bicycle storage for one bicycle per unit.

Supplemental Standards

Minimum twenty feet between buildings on the same lot. This includes dwelling groups built over a single parking structure.

If parking is completely underground (under lowest existing natural grade elevation), a one-foot setback from all property lines is required.
