2.28.010  Established.

A public library in and for the city is established, pursuant to the provisions of Sections 27301 through 27456 of the Education Code. The public library shall be known as the Sonoma Public Library. (Ord. 483 § 1(C), 1974; Ord. 101 § 1, 1909).

2.28.020  Management.

The management of the public library shall be conducted by a board of library trustees to consist of five members, to be appointed by the city council. Such trustees shall severally hold office for three years, serving without compensation; provided, that the members of the first board appointed shall so classify themselves by lot that one of their number shall go out of office at the end of the current fiscal year, two at the end of one year thereafter, and the other two at the end of two years thereafter.

Men and women shall be equally eligible to such appointment, and vacancies shall be filled by appointment for the unexpired term in the same manner. (Ord. 483 § 1(B), 1974; Ord. 101 § 2, 1909).

2.28.030  Trustees – Meetings – Time – Place.

The board of library trustees shall meet at least once a month at such times and places as they may fix by resolution. Special meetings may be called at any time by three trustees, by written notice served upon each member at least three hours before the time specified for the proposed meeting. A majority of the board shall constitute a quorum for the transaction of business. The board shall appoint one of their number president who shall serve for one year and until his successor is appointed, and in his absence shall select a president pro tem. The board shall cause a proper record of its proceedings to be kept, and at the first meeting, it must immediately upon organizing cause to be made out and filed with the State Librarian at Sacramento, a certificate showing that such library has been established, with the date thereof, the name of the trustees, and of the officers of the board chosen for the first year. 2.28.040  Trustees – Powers.

The board of library trustees shall have power:

First: To make and enforce all rules, regulations and bylaws necessary for the administration, government and protection of the library under its management, and all property belonging thereto;

Second: To administer any trust declared or created for such library, and receive by gift, devise or bequest and hold in trust or otherwise, property situated in this state or elsewhere, and where not otherwise provided, dispose of the same for the benefit of such library;

Third: To prescribe the duties and powers of the librarian and other officers and employees of the library; to determine the number of and appoint all such officers and employees, and fix their compensation, which officers and employees shall hold their offices or position at the pleasure of the board;

Fourth: To purchase necessary books, journals, publications and other personal property;

Fifth: To purchase such real property, and erect or rent and equip such building or buildings, room or rooms, as may be necessary when in their judgment a suitable building or portion thereof has not been provided by the city council for such library;

Sixth: To require the Secretary of State and other state officials to furnish the library with copies of any and all reports, laws, and other publications of the state not otherwise disposed of by law;

Seventh: To borrow books from, lend books to and exchange the same with other libraries, and to allow nonresidents to borrow books upon such conditions as they may prescribe;

Eighth: To do and perform any and all other acts and things necessary or proper to carry out the provisions of this chapter or the provisions of Sections 27301 through 27456 of the Education Code. (Ord. 483 § 1(C), 1974; Ord. 101 § 4, 1909).

2.28.050  Trustees – Report.

The board of library trustees shall, on or before the last day of July in each year, make a report to the city council, giving the condition of the library on the thirtieth day of June preceding, together with a statement of their proceedings for the year then ended, and must immediately upon the publication of such report forward a copy thereof for filing to the State Library at Sacramento. (Ord. 101 § 5, 1909).

2.28.060  Access.

The Sonoma Public Library shall be forever free to the inhabitants and nonresident taxpayers of Sonoma, subject always to such rules, regulations and bylaws as may be made by the board of library trustees; and provided, that for violations of the same a person may be fined or excluded from the privileges of the library. (Ord. 101 § 6, 1909).

2.28.070  Book lending – Contracts.

The board of library trustees may contract with the city councils of neighboring municipalities, or with the boards of supervisors of the counties in which public libraries are situated, for lending the books of such library to residents of such counties or neighboring municipalities upon a reasonable compensation to be paid by such counties or neighboring municipalities. (Ord. 101 § 7, 1909).

2.28.080  Property – Title.

The title to all property acquired for the purposes of such library, when not inconsistent with the terms of its acquisition or otherwise designated, shall vest in the city, and in the name of the city may be sued for and defended by action at law or otherwise. (Ord. 101 § 8, 1909).
