7.04.010  Purpose.

This chapter establishes within the city the enforcement authority and rules pertaining to the enforcement, observation and inspection of public health statutes, orders and other rules and regulations promulgated by the State Department of Health Services and contained in the Health and Safety Code of the state of California. (Ord. 93-5 § 2, 1993).

7.04.020  Definitions.

The following terms and phrases shall be defined as set forth below:

A.  "Health officer" means the health officer of the county of Sonoma, state of California, or his or her authorized representative.

B.  "Health permit" means a permit issued by the health officer pursuant to this chapter.

C.  "Person" means any individual, firm, copartnership, corporation or association.

D.  "Structure" is that which is built up or composed of parts joined together in some definite manner. (Ord. 93-5 § 2, 1993).

7.04.030  Health officer designated.

Pursuant to Section 476 of the Health and Safety Code of the state of California, the city council consents to and the county health officer shall observe and enforce, in the city, all of the following:

A.  Orders, quarantine regulations and rules prescribed by the State Department of Public Health and other rules and regulations issued under the provisions of the Health and Safety Code of the state of California;

B.  Statutes relating to public health. (Ord. 93-5 § 2, 1993).

7.04.040  Permits and fees.

Persons subject to the rules prescribed by the State Department of Health and other rules and regulations issued under the provisions of the Health and Safety Code of the state of California shall be required to obtain permits when required by the health officer and shall pay to the county all reasonable fees necessary to pay for the cost of enforcing the provisions of this chapter. (Ord. 93-5 § 2, 1993).

7.04.050  Issuance of permit.

Health permits shall be issued only after application to and approval by the health officer. (Ord. 93-5 § 2, 1993).

7.04.060  Permit form.

Applications for health permits shall be in writing on a form prescribed by the health officer and signed by the applicant. (Ord. 93-5 § 2, 1993).

7.04.070  Inspection of work.

All buildings, structures, businesses, premises, property or work subject to the rules prescribed by the State Department of Public Health and other rules and regulations provided in the Health and Safety Code of California and all work for which a health permit is required shall be subject to inspection by the health officer in accordance with and in the manner provided by state law. All work shall remain accessible and exposed for inspection purposes until approved by the health officer. (Ord. 93-5 § 2, 1993).

7.04.080  Approval required.

All work for which a permit is required shall be approved by the health officer prior to use. Final health approval shall be granted following compliance by the applicant with all applicable statutes, orders, quarantines, rules or regulations, and a finding by the health officer that the applicant is in substantial compliance with such laws, rules and regulations and this chapter. (Ord. 93-5 § 2, 1993).

7.04.090  Violations – Penalty.

Any person, corporation or firm who or which violates any provision of any code enacted by the ordinance codified in this chapter, or any lawful order thereunder, is guilty of a misdemeanor, punishable by a fine of not more than $1,000, or by imprisonment for not more than six months, or both. Every such violation shall be deemed a separate offense for each day or portion thereof during which such violation continues. (Ord. 93-5 § 3, 1993).
