17.42.010 Purpose and intent.
The purpose and intent of planned development district is to provide a flexible zoning classification to:
A. Allow the city council to consider preplanned and well designed developments which may combine different land uses;
B. Allow developers to vary from requirements of other zoning districts in order to provide the city a more orderly arrangement for the development of land than might otherwise occur;
C. Allow the city council to preselect areas where the planned development approach to development is the best due, to environmental considerations or concerns for the scale, timing or feasibility of development;
D. Is intended to implement the SP, special planning, designation of the city’s general plan. (Ord. 322 §1(part), 1992)
17.42.020 Uses permitted.
There are no uses permitted outright in the PD zone. (Ord. 322 §1(part), 1992)
17.42.030 Development plan required.
A. The PD zoning classification may be used alone as a base zone or as a combining zone (in combination with another zoning classification).
B. Any development or use of lands within a PD base zone or combining zone requires approval by the city council of a comprehensive development plan application unless a use permit is approved pursuant to Section 17.42.050. Prior to any consideration of such plans by the city council, the planning commission shall review the plan, hold one or more public hearings concerning the plan and provide recommendation(s) for the city council’s consideration. Application and application processing requirements shall be established by resolution of the city council. If approved, the development plan will henceforth guide development and control land uses on the site.
C. Public Improvements. The city shall require posting or cash, a savings and loan certificate, or a performance bond issued by a corporate surety company in an amount to be determined by the city engineer and approved by the planning commission to cover the cost of all or part of the public improvements deemed necessary on or off the site of the proposed development prior to the issuance of a building permit for the first phase of construction.
D. Building Permits. Prior to the issuance of any building permit for construction in a PD zone, the plot plan(s), building plan(s) and specifications shall be checked by the city engineer or planning official to assure compliance with design, terms and conditions of the approved development plan. 17.42.040 Uses permitted with a conditional use permit.
The following uses may be permitted in areas where PD is used as a base zone without meeting the requirements of Section 17.42.030, provided a conditional use permit is first obtained:
A. One single-family dwelling unit and one second-family dwelling unit with customary accessory structures;
B. Quasi-public buildings or structures and uses of an historic, cultural or public service type;
C. Commercial mines and quarries, rock, sand and gravel borrow pits and mineral exploration or claim proving activities subject to the provisions of Chapter 8.36 as may be applicable;
D. Land clearing or grading activities or the movement of more than thirty yards of earth material;
E. Cemeteries;
F. Erection, construction or alteration of gas, electric, water, sewage disposal, communication facilities or roads. (Ord. 322 §1(part), 1992)
17.42.050 Site development standards.
A. All uses proposed by a development plan or use permit shall conform to the site development standards required by the district in which such a use is normally permitted, except where the city finds that the overall development will be improved by a deviation from these standards.
B. When the PD classification is used as a base zone and not combined with another zoning classification, overall density of any residential development shall not exceed a net of one unit per seven thousand square feet or a designed capacity of more than 2.28 persons per seven thousand square feet of the subject parcel’s area before development.
C. When the PD classification is used as a base zone and not combined with another zoning classification, maximum building coverage of any development shall not exceed twenty-five percent of the subject parcel’s area before development.
D. When the PD classification is combined with another zoning classification, overall density and maximum building intensity shall not exceed the limits specified for the zoning classification with which the PD is combined. (Ord. 322 §1(part), 1992)
17.42.060 Conformance to city design standards.
Applications for development plans shall conform to all applicable standards and requirements of this title such as landscaping, off-street parking and street improvements unless a variance or waiver is applicable and is obtained. Likewise, such applications shall conform to all other applicable standards and requirements as may be contained in other titles within the Municipal Code or as may be adopted by resolution and maintained by the city clerk.
