9.64.010 Regulating public consumption of marijuana.

A. The consumption of marijuana otherwise permitted by California Health and Safety Code Section 11362.1 for nonmedical purposes or Section 11362.5 for medical purposes is prohibited on any public property or in any facility or space to which members of the public have access.

B. Any person who violates subsection (A) of this section shall be guilty of an infraction, punishable by:

1. A fine, not exceeding $100.00 for a first violation;

2. A fine, not exceeding $200.00 for a second violation of this chapter within one year;

3. A fine, not exceeding $500.00 for each additional violation of this chapter within one year. (Ord. 17-02 § 1; Ord. 16-01 § 5).
