12.34.070 Exemption to participation in curbside collection.
A. Any occupant, who, due to a physical or mental disability as defined in Section 12.34.020 B, is unable to place the curbside cart at the curb, shall be exempt from participation in curbside service and shall receive backyard service for the same fee as charged curbside customers. This exemption shall be determined initially when the survey to establish curbside service is completed, and at other times by the resident’s application to the refuse division. The physically or mentally disabled occupant shall sign a statement under penalty of perjury that he or she is disabled as defined in Section 12.34.020 B, unable to remove the curbside cart to the curb, and that no one else residing in the premises can place the curbside cart at the curb. The disabled occupant must notify the City refuse division within thirty days if he or she ceases to reside in the premises or is no longer disabled.
B. Any occupant, who is temporarily disabled as defined in Section 12.34.020 B, and is unable to place the curbside cart at the curb, shall be exempt from participation in curbside service and shall receive backyard service for the same fee as charged curbside customers. The occupant will notify the refuse collection division of the disability and give an estimated date for the end of the disability.
C. Persons over sixty-two years of age may choose to exempt themselves from the semi-automated curbside collection. The occupant over the age of sixty-two years shall sign a statement that he or she is over sixty-two years of age and that everyone else residing in the premises is exempt from curbside service. The occupant may sign this statement at the time the original survey is completed or at any time thereafter. Backyard service shall be provided within ten days of an occupant’s request to the refuse division under this exemption.
D. In instances in which the terrain imposes limits on curbside participation, occupants may not be required to place their cart at the curb, but they will be required to place their cart as near to the curb as possible in a location mutually agreed upon by the resident and the City. They will receive a wheeled cart unless inappropriate to their specific situation. There will be no charge for an exception during the first eighteen months. The current surcharge for stairs, however, will remain in effect during this period. Following the eighteen months, a special fee will be assessed for exceptions.
E. The names and addresses of occupants exempted under subsections A and C above are protected as confidential under the California Constitution’s right to privacy provision. (Ord. 5667-NS § 7, 1985)
