8.28.010 Firearm defined.

“Firearm” means guns, pistols, shotguns, revolvers or any other firearms of a similar nature. [Ord. 1201, 1966; Ord. 462, 1955; prior code § 8.25.010].

8.28.020 Gallery or range permits required.

(A)    The Board of Supervisors may, upon application and after public hearing as set forth in this section, grant a conditional permit or permits to operate and conduct a private, noncommercial shooting gallery, trap shooting, rifle or target range, and the person or persons having such permit shall not be subject to the provisions of this chapter. Notice of the public hearing shall be given in accordance with the provisions of SCCC 18.10.223.

(B)    An application for such a permit shall be filed stating the particular place where the same is to be conducted, together with an application fee established by resolution, and a petition in support of the application signed by not less than 25 residents who reside within a one-quarter mile radius of the subject property or signed by at least 50 percent of the residents who reside within a one-quarter mile radius of the subject property. Any such permit shall not be transferable and shall be revocable upon good cause appearing therefor to the Board.

(C)    An application shall only be approved if the Board finds that the proposed location of the shooting gallery, trap shooting, rifle or target range and the conditions under which it would be operated or maintained will not be detrimental to the health, safety or welfare of persons residing or working in the neighborhood or the general public, and will not be materially injurious to properties or improvements in the vicinity.

(D)    If the shooting gallery, trap shooting, rifle or target range is to be open to the public or members of a group, club or other organization, or if payment of any kind is to be received from users thereof, the application shall also be subject to County land use regulations, including all application and findings provisions, and shall be processed as a Level VII application. 8.28.030 Discharge prohibited in certain areas.

It is unlawful for any person to discharge firearms of whatsoever kind or character within the following described areas of the County:

(A)    Beginning at a point on the centerline of Hecker Pass Road (State Highway 32-A) on the northwesterly projection of the southeastern boundary of lands conveyed to S. H. Gandrup by deed recorded in Volume 1328, Official Records at Page 169, Santa Cruz County Records; thence southeasterly, along said projection and boundary southerly, southwesterly and southeasterly along the southwestern, western, northwestern, and southwestern boundaries of said lands of Gandrup and the southeasterly projection of said southwestern boundary to the southeastern boundary of land conveyed to S. B. Kett, et ux, by deed recorded in Volume 1649 Official Records at Page 92, Santa Cruz County Records; thence northeasterly along said southeastern boundary to the northwesterly projection of the centerline of Carlton Road; thence southeasterly along the centerline of Carlton Road to the centerline of Lakeview Road; thence southwesterly along the centerline of Lakeview Road to the centerline of Riverside Road; (State Highway 67-A); thence northeasterly along the centerline of Riverside Road to the northwesterly projection of the western boundary of lands conveyed to West Coast Ice Company by deed recorded in Volume 1012 Official Records at Page 234, Santa Cruz County Records; thence southeasterly along said projection and boundary of said lands of West Coast Ice Company to the County boundary in or near the Pajaro River; thence westerly along said County boundary to the easterly corporate boundary of the City of Watsonville; thence northerly and northwesterly along said corporate boundary to East Lake Avenue and said corporate boundary, and thence along said corporate boundary northeasterly to the point where said corporate boundary leaves said East Lake Avenue; and thence continuing northeasterly along the centerline of East Lake Avenue and the centerline of Hecker Pass Road to the point of beginning.

Beginning at the northwest corner of the Rancho De La Canada del Rincon, said point is marked in two places with an old mark “C.R.J.”; thence running along the northerly boundary of said Rancho De La Canada del Rincon north 82° 13' east 1793.55 feet to the northwest corner of Parcel 6 of the lands conveyed to the Felton Water Company by deed recorded June 16, 1953, in Volume 918, Page 188, Official Records of Santa Cruz County; thence leaving the said Rancho boundary and running along the westerly and southerly boundary of said lands of Felton Water Company the following courses and distances. Beginning at a point on the existing boundary of the No-Shooting Area as described in Santa Cruz County Code Section 8.28.030(B), which point of beginning is also the intersection of the northwesterly right of way of Trout Gulch Road and the northwesterly projection of the northeasterly boundary of Lot 5, Block A, Forest Glen Subdivision No. 4, filed for record October 9, 1925, in Book 23 of Maps at Page 12, Santa Cruz County Records; thence from said point of beginning continuing northerly along the westerly right of way line of Trout Gulch Road to a point on said right of way line 177.5 feet, more or less, north of the southerly boundary of Parcel 2, as shown on Record of Survey of the Lands of Phillip Page et ux, recorded June 3, 1982, in Volume 71 of Maps at Page 51, Santa Cruz County Records, said point being directly across Trout Gulch Road from the point which is the intersection of the easterly right of way line of Trout Gulch Road and the northerly right of way line of Los Arboles Road; thence across Trout Gulch Road to said point of intersection, the true point of beginning; thence generally southeasterly along the northerly right of way line of Los Arboles Road to its intersection with the westerly boundary of the Lands of Muriel Johnson, as described in the deed recorded September 9, 1983, in Volume 3623 of Official Records at Page 35, Santa Cruz County Records; thence northerly along said westerly boundary and continuing northerly along the westerly boundaries of the parcels adjacent to the westerly right of way line of Los Arboles Road, as Los Arboles Road runs north, to the most northerly corner of the lands conveyed to John F. and Joan P. Cunniff by deed recorded September 11, 1984, in Volume 3754 of Official Records at Page 426, Santa Cruz County Records, said point being on the northerly boundary of said lands of Cunniff; thence easterly along said last mentioned northerly boundary to its intersection with the westerly boundary of Parcel B, as shown on Parcel Map of Lands of William and Debi Sanchez, recorded May 13, 1988, in Volume 49 of Maps at Page 1, Santa Cruz County Records; thence northerly along said westerly boundary of Parcel B to its intersection with the northerly boundary of Parcel B, which boundary is also the northerly boundary of the Aptos Rancho; thence easterly along said northerly boundary of Parcel B and Parcel A, as shown on said last mentioned Parcel Map of Lands of Sanchez to said northerly boundary’s intersection with the easterly boundary of Parcel A, as shown on said last mentioned parcel map; thence southerly along said easterly boundary to a point which is the most southerly point of said last mentioned Parcel A and also the intersection of the northerly and easterly boundaries of the Estate of Dorothy Matthews, as shown on said last mentioned parcel map as previously recorded July 11, 1978, in Volume 2937 of Official Records at Page 277, Santa Cruz County Records; thence southerly along the easterly boundary of said lands of the Estate of Dorothy Matthews to the most southerly point of said lands of Matthews, as shown on Record of Survey Showing Boundary Adjustment Between Parcels One and Two of Lands of Jeanne Marie Smith, recorded March 24, 1981, in Volume 70 of Maps at Page 21, Santa Cruz County Records; thence North 62°53' West, 1014.87 feet, along the southwesterly boundary of said last mentioned lands of Matthews, as shown on said last mentioned record of survey, said southwesterly boundary also being a portion of the northerly boundary of the existing Non-Shooting Area described in Santa Cruz County Code Section 8.28.030(B), to said southwesterly boundary’s intersection with the easterly right of way line of Los Arboles Road; thence South 31°21' West, along said easterly right of way line to the most southerly point of the Los Arboles Road right of way; thence northwesterly along the southerly right of way line of Los Arboles Road to its intersection with the easterly right of way line of Trout Gulch Road; thence northerly along said right of way line of Trout Gulch Road back to the point of beginning.

(P)    Big Basin State Park Adjacent Area. Situated in the County of Santa Cruz and being more particularly bounded as shown in Exhibits A and B of Ordinance 4505, on file in the Office of the Clerk of the Board.

(Q)    Upper Eureka Canyon Area. Situated in the County of Santa Cruz and being more particularly bounded as shown in Exhibit A and described in Exhibit B, attached to Ordinance 5142, and made a part hereof by reference. 8.28.040 Exceptions.

The provisions of this chapter shall not apply to the following exceptions:

(A)    Employees of Federal, State and local governmental agencies when the discharge of firearms is necessary in performance of their official duties for the protection and/or welfare of the public;

(B)    Private landowners, on their own property, when the discharge of firearms is necessary to eliminate pests or crop-destroying animals on their property;

(C)    Existing shooting galleries, trap shooting, rifle or target ranges operating within said restricted territory pursuant to a valid use permit on the effective date of the addition of the territory as a part of this chapter;

(D)    Persons legally discharging firearms for the purpose of dog training with a 10-gauge or smaller shotgun and using no larger than size two shot; provided, however, that all discharge of firearms is prohibited within 150 yards of the Pajaro River Levee from a point 1,250 yards (approximately 0.7 miles) downstream of Thurwachter Bridge south to the Pacific Ocean. Such persons must hold a valid State dog training permit, have written permission from the landowner and operate only during those months permitted by the State. 8.28.050 Discharge near buildings.

Notwithstanding any of the other provisions of this chapter allowing the discharge of any firearms, it is unlawful for any private person other than the owner, person in possession of the premises, or a person having the express permission of the owner or person in possession of the premises to discharge any firearms, including shotguns, anywhere in the unincorporated area of the County within 150 yards of any occupied dwelling house, residence, or other building or barn or other outbuilding used in connection therewith. 8.28.060 Violation—Penalty.

A violation of any of the provisions of this chapter shall be a misdemeanor and punishable as provided by this code. [Ord. 3620 § 4, 1985; Ord. 1201, 1966; Ord. 462, 1955; prior code § 8.25.040].

8.28.070 Discharging onto property of another without permission.

It shall be unlawful for any person to discharge any firearm in such a manner as to cause a projectile from that firearm to land on the property of another without the permission of the property owner. [Ord. 4004 § 1, 1989].
