12.08.010 Permit--Required.

It is unlawful for any person, firm or corporation to construct or maintain a driveway across any public sidewalk, parkway or street without first having obtained a permit therefor as herein required. (Ord. 927, 1968; Ord. 336 §1, 1954).

12.08.020 Permit--Application.

Application for such permit shall be made to the city street superintendent and shall state the location, grade and dimensions of the proposed driveway and the purpose for which it is desired. (Ord. 336 §2, 1954).

12.08.040 Permit--Issuance--Applicant right to appeal.

A. Upon receipt of an application for permit to construct or maintain a driveway in accordance with this chapter, the city manager or his designee shall determine whether such proposed driveway constitutes any risk to public safety, and further, whether the same proposes construction according to city standards. Upon finding no risk to public safety and compliance with all applicable city standards, the city manager or his designee shall issue a permit therefor.

B. The fee for said permit will be adopted by city council resolution.

C. The city manager or his designee may inspect any materials or construction details as may be necessary to assure compliance with the terms of the permit or any applicable city standards shall constitute an ordinance violation and shall be punishable under the general penalty ordinances of the city.

D. Upon refusal of the city manager or his designee to issue a driveway permit under this chapter, the applicant shall have the right to appeal to the council within thirty days after such refusal. (Ord. 1969 §1(part), 2013; Ord. 1877 §3, 2006; Ord. 1617 §1, 1989; Ord. 336 §4, 1954).

12.08.050 Permit--Revocation.

Permits for construction and maintenance of any driveway now or hereafter constructed or maintained may be revoked by the council if the same shall not be maintained in a safe condition or constructed contrary to the provisions of this chapter or in the event the council deems the maintenance of any such driveway a menace to the public safety or detrimental to the public welfare. (Ord. 336 §5, 1954).

12.08.060 Unlawful acts.

It is unlawful for any person, firm or corporation to construct or maintain any driveway for which a permit is required contrary to any of the provisions of this chapter. (Ord. 336 §6, 1954).

12.08.070 Penalties.

Any person violating any of the provisions of this chapter shall upon conviction be subject to punishment under the general penalty ordinance. (Ord. 1716 §16, 1995; Ord. 336 §7, 1954).
