2.08.010 Adopted.

Midvale City operates under a six-member council form of government and is a city of the fourth class as determined by Utah law. The city is governed by a six-member council comprised of five council members and a mayor. The mayor votes on each matter where there is a tie-vote of the council; on ordinances that enlarge or restrict the mayor’s powers, duties or functions; and in the appointment or dismissal of a city manager. The mayor serves as the chief executive officer and the city manager serves as chief administrative officer overseeing the day-to-day administrative functions of the city. 2.08.020 City government vested in the city council and city manager.

A.    City government is vested in a city council, which shall be the governing body of the city, and a city manager appointed by the mayor with the advice and consent of the city council.

B.    The city council, composed of the mayor and five city council members, constitutes the legislative branch of city government.

2.08.030 City manager’s responsibilities to the city council.

The city manager’s responsibilities to the city council are to:

A.    Identify policy issues;

B.    Recommend policy to the city council;

C.    Guide, educate, and train subordinates;

D.    Implement city council policies and evaluate the overall administration within the city;

E.    Suggest policy needs and solutions;

F.    Carry out the will of the city council as expressed by ordinance and resolution;

G.    Provide information to the city council; and
