13.15.010 Time-of-day watering parameters.

Sprinkler irrigation of public and private amenity landscapes is prohibited between the hours of 10:00 a.m. and 6:00 p.m. [Ord. 5-9-02 § 3.]

13.15.020 Definitions.

“Private landscape” means a parcel of land owned by a private entity upon which grass and plants require irrigation.

“Public landscape” means a parcel of land owned by public entities upon which grass and plants require irrigation.

“Sprinkler irrigation” means the application of water to land and plants by distributing water under pressure through spray, rotary or drip heads. [Ord. 5-9-02 § 4.]

13.15.030 Applicability of time-of-day watering chapter.

The provisions of this chapter shall apply to all landscapes within the town of Manila. This chapter does not apply in the following situations:

A.    New lawns that require frequent irrigation for establishment purposes within 90 days of planting.

B.    Short cycles required for testing, inspecting and maintaining irrigation systems.

C.    Irrigation to public or private landscape accomplished by alternative water sources other than Manila culinary water. This may include but is not limited to Manila Garden Club water and available secondary water sources. [Ord. 5-9-02 § 5.]

13.15.040 Violation, penalty.

A.    Property owners found to be in violation of this chapter shall be subject to the following penalties. Monetary penalties will be imposed for the first three violations and a written notice of violation will be sent to the property owner of Daggett County record. The specified monetary penalty will then be added to the next monthly water billing. A fourth violation will cause the town of Manila to proceed with a notice of cessation of water service for the violating property.

B.    Penalties for violation of this chapter:

1.    Violation one: $5.00 fine;

2.    Violation two: $10.00 fine;

3.    Violation three: $20.00 fine;

4.    Violation four: water shutoff notice.

C.    Appeal Process. The Manila town council may choose to hear the circumstances surrounding the alleged violation of this chapter. The decision of that body is to be considered final. Property owners may ask to be placed on the monthly Manila town council agenda. [Ord. 5-9-02 § 6.]
