10.04.142 Impoundment – When – Authority.
The chief of police, and his designated agents, are empowered to impound motor vehicles for violation of parking ordinances other than meter violations and further to impound abandoned vehicles, unlicensed vehicles, vehicles obstructing traffic of any kind, vehicles parked on parade routes after posted notice of no parking is given on said route for two hours or more or published notice is given in a weekly newspaper of general circulation once at least five days prior to such parade, vehicles left unattended by reason of the arrest of the operator or owner, and vehicles parked in a “no parking, tow-away zone” space, or in a designated handicapped parking zone under state law. 10.04.146 Impoundment – Expense borne by owner.
Impoundment of vehicles for the reasons set forth in PTMC 10.04.142 shall be at the expense of the owner or operator of the impounded vehicle, and shall be paid by him to the towing or garage company having custody of the vehicle. (Ord. 1753 § 2, 1976).
10.04.148 Impoundment – Nonliability of city.
No liability shall attach to the city or any of its agents for damage arising from towing or storage of vehicles impounded under the terms of the ordinance codified in this section and PTMC 10.04.142 and 10.04.146 or any other ordinance of the city. (Ord. 1753 § 3, 1976).
10.04.150 Method of parking.
On all streets of the city no person shall stop, stand or park a vehicle in any designated public parking space so that any part of such vehicle protrudes beyond the markings designating such space. On all streets of the city no motor vehicle shall be permitted to stand or park unless the same has been placed with the right-hand wheels parallel with the curb and within 12 inches thereof, excepting that on that portion of Taylor Street between Water and Front Street, on the east side, Tyler Street between Washington Street and Water Street, Washington Street between Quincy Street and Adams Street on the north side, Washington Street between Quincy Street and Monroe Street on the south side, Madison Street between Water Street and Washington Street on the east side, Tyler Street between Lawrence Street and Clay Street on the west side, Fillmore Street between Water Street and Washington Street on the southwest side, and Harrison Street between Washington Street and Jefferson Street on the west side, no vehicle will be permitted to stand or park unless the same has been placed with the longitudinal line of its chassis at an angle of 45 degrees to the curb and with its right front wheel within six inches of the curb; and excepting that on that portion of Tyler Street between Water Street and Front Street, Polk Street between Water Street and Washington Street, Tyler Street between Water Street and Washington Street on the north end, Tyler Street intersecting with Washington Street that abuts the bluff, and Fillmore Street between Water Street and Washington Street on the northeast side, no vehicle will be permitted to stand or park unless the same has been placed with the longitudinal line of its chassis at an angle of 90 degrees to the curb with its front wheels within six inches of the curb; provided, however, that no standing or parking whatsoever of motor vehicles will be permitted upon the streets of the city within those certain zones which the chief of police or city council have caused to be painted yellow or red, or with the words “No Parking,” whether by lettering upon the curb or on signs erected for the purpose; and further provided, that parking only for special purposes will be permitted upon streets or portions of streets where the chief of police or city council have caused to be placed signs reading “No Parking” except for purposes designated on the signs, as, for example and not in limitation, “No Parking – Ferry Traffic.” (Ord. 2813 § 1, 2002; Ord. 2802 § 1, 2002; Ord. 2000 § 2, 1984; Ord. 1777 § 1, 1976; Ord. 1639 § 1, 1972; Ord. 1531 § 1, 1968; Ord. 1490 § 1, 1966).
10.04.170 Taxicabs and bus zones.
With the consent of the owners of property abutting on any parts of streets mentioned in PTMC 10.04.150, the city manager, public works director and chief of police, acting together, are hereby granted the power and authority to designate zones for taxicabs and autobuses to stand or park, on any of the parts of streets mentioned in PTMC 10.04.150, such designation to be in writing and filed with the city clerk; provided, however, that such taxicabs and autobuses shall not be subject to the hours of standing or parking, as provided for in PTMC 10.04.190, 10.04.194 and 10.04.200; and provided further, that physicians be allowed to park their autos at all hours without time limit, and also granting the chief of police and his designated agents the authority to impound vehicles which are not taxicabs or autobuses from said zones. 10.04.180 Loading and unloading.
It is unlawful for any person to stand or park any motor or other vehicle used in the delivery of goods, wares and merchandise, on any of the parts of streets named in PTMC 10.04.150, for any longer period than sufficient time to load or unload such goods, wares and merchandise. (Ord. 1024 § 3, 1933).
10.04.190 Two-hour parking limit.
It shall be unlawful for any person to stand or park any motor vehicle continuously at the same place for more than two hours between the hours of 9:00 a.m. and 5:00 p.m. on any day, except Sundays and holidays, on the following described streets of the city:
A. On Water Street from Harrison Street to Madison Street, and from Madison Street to Monroe Street, on the street side adjacent to and in front of City Hall;
B. On Taylor Street from Front Street to Washington Street;
C. On Adams Street from Front Street to Washington Street;
D. On Washington Street from Tyler Street to Quincy Street;
E. On Lawrence Street from Polk Street to Taylor Street;
F. On Tyler Street from Washington Street to Front Street and from Lincoln Street to Clay Street;
G. On Quincy Street from Washington Street to Water Street;
H. On Polk Street from Water Street to Washington Street;
I. On Madison Street between Front Street and Washington Street;
J. On the 100 block of Quincy Street between Front Street and Water Street;
K. On “Waterfront Place,” in the area adjacent to Quincy Street and Front Street, to the west and east of, and adjacent to, the Quincy Street dock, and behind the N.D. Hill Building;
L. On the 200 block of Monroe Street from Water Street to Washington Street;
M. Calhoun Street between Water Street and Front Street on the northeast side of the street;
N. On Fillmore Street between Water Street and Washington Street;
O. On the easterly side of Grant Street between 7th Street and the driveway entrance to the north;
P. On the westerly side of Sheridan Street from 9th Street to 10th Street; and
Q. On the northerly side of 9th Street from Sheridan Street to Grant Street;
R. Penalty. A violation of this section shall be as prescribed in PTMC 10.04.205, Violations – Penalties, as now or hereafter amended. 10.04.192 Eight-hour parking.
It shall be unlawful for any person to stand or park any motor vehicle continuously at the same place for more than eight hours on the following described street:
A. Calhoun Street between Water Street and Front Street on the southwest side of the street. (Ord. 2767 § 1, 2001).
10.04.194 Fifteen-minute parking.
It is unlawful for any person to stand or park any motor vehicle continuously at the same place for more than 15 minutes between the hours of 9:00 a.m. and 5:00 p.m. on any day except Sundays and holidays, on the following streets of the city:
A. Harrison Street between Washington Street and Jefferson Street, on the west side.
B. Van Buren Street between Washington Street and the alley, on the east side.
C. The two parking spaces immediately in front of the entry door into the Waterman and Katz Building, on the 100 block of Quincy Street.
D. One parking space on Water Street, between Madison Street and the parking area bordering the west side of the police station (directly in front of the police station).
E. The first parking space on the west side of Taylor Street closest to and north of Water Street (at the northwest corner of Taylor Street and Water Street).
F. The second parking space on the east side of Taylor Street, adjacent to and north of the parking place reserved for physically disabled persons which is closest to and north of Water Street (at the northeast corner of Taylor Street and Water Street).
G. The second parking space on the west side of Adams Street, closest to and north of the parking place reserved for physically disabled persons which is closest to and north of Water Street (at the northwest corner of Adams Street and Water Street).
H. The first parking space on the east side of Adams Street closest to and north of Water Street (at the northeast corner of Taylor Street and Water Street).
I. The fourth, fifth, and sixth spaces (counting the easternmost space as number one) within a group of 12 head-in spaces on the south side of Washington Street, east of Monroe Street. (Ord. 2836 § 1, 2003; Ord. 2743 § 1, 2000; Ord. 2692 § 2, 1999; Ord. 2000 § 4, 1984).
10.04.200 Twenty-four hour parking.
In the absence of other time limitation, it is unlawful for the owner, or other person in possession of any vehicle, to park or stand, or cause or permit to be parked or stood, such vehicle on any street or public right-of-way in the city for a period of more than 24 consecutive hours, and provided that this section shall apply to city-owned off-street parking areas established as such, and further provided that nothing herein shall prevent the limiting of parking to a lesser period of time, either by ordinance or by order of the chief of police. (Ord. 1812 § 2, 1978; Ord. 1509 § 1, 1967).
10.04.202 Restrictions.
A. Motor vehicle parking is prohibited along the east side of Walnut Street between V Street and W Street. No parking shall be permitted in this area of Walnut Street at any time.
B. No parking shall be permitted between 11:00 p.m. and 6:00 a.m. on all days of the week along the west side of Walnut Street between the intersections of V Street and W Street.
C. No parking shall be permitted between 11:00 p.m. and 6:00 a.m. on all days of the week along the north portion of W Street between Chestnut Street and Walnut Street.
D. No parking shall be permitted at any time on SR20 from the ferry terminal to Kearney Street, unless making authorized deliveries in the designated loading zone between Benton and Pierce Streets.
E. In accordance with PTMC 10.04.150, the department of public works is hereby directed to post all necessary signs to carry out the requirements of this section. If feasible, the signs shall state the ordinance number of the ordinance codified in this section on the face of the signs. Further, the Port Townsend police department shall enforce the requirements of this section in accordance with PTMC 10.04.205.
F. Penalties. Any violations of the requirements of this section shall be subject to penalties and fines in accordance with PTMC 10.04.205. (Ord. 2767 § 3, 2001; Ord. 2630 §§ 1 – 5, 1998).
10.04.205 Violations – Penalties.
The following penalties are established for violations of this chapter:
A. Penalty for violations if paid within 15 days: $15.00;
B. Penalty for violations if paid after 15 days: $30.00. (Ord. 2733 § 1, 1999; Ord. 2354 § 2, 1993).
10.04.208 Moving vehicle to avoid time limit.
No person shall move and repark a vehicle on either side of a street within the same block in order to avoid a parking time limit regulation specified for either side of the street in that particular block. (Ord. 2354 § 2, 1993).
10.04.210 Current license required.
It is unlawful to park or stand upon any street or public right-of-way in the city any vehicle not bearing the proper license plate or tag currently required for any such vehicle. Violations of this provision shall be subject to such penalties as are imposed under the monetary schedule for traffic infractions established by the Infraction Rules for Courts of Limited Jurisdiction (IRLJ) or as may be established by state statute for such an infraction. (Ord. 2354 § 3, 1993; Ord. 1509 § 2, 1967).
10.04.220 Program for paid parking utilizing parking passes.
The public works department in conjunction with the police department is authorized to implement a paid parking program utilizing parking passes, with the following terms and conditions:
A. The parking pass would be sold by the city for $5.00 per pass.
B. A pass, properly issued and displayed on the dashboard, would extend parking for two hours.
C. The pass would only be available for use in spaces marked two-hour parking.
D. The parking pass, in books of 20 or otherwise, as determined by the public works director, would be made available for purchase by merchants for their distribution and use, by re-sale or otherwise as determined by the merchant.
E. Individual or books of passes would also be available for purchase from the city finance department.
F. Net proceeds (after printing costs) from sale of parking passes shall be used for parking and streetscape improvements in the historic commercial district.
G. Parking passes shall not be altered except as provided by rules and regulations approved by the public works director and the police chief.
The public works director is authorized to adopt rules and regulations that are consistent with the above terms and conditions and which otherwise implement the program for paid parking utilizing parking passes. A copy of any rules and regulations shall be kept for public inspection and copying by the public works department and the city clerk’s office. (Ord. 2894 § 1, 2005).
10.04.225 Paid parking utilizing parking passes – Violation.
Any person who, for purposes of extending parking times or avoiding parking violation(s), (1) alters a parking pass (except as provided by rules and regulations approved by the public works director), or (2) forges a parking pass, or (3) commits, authorizes, aids or abets or attempts to defraud the city in connection with the program for paid parking utilizing parking passes shall be guilty of a misdemeanor and upon conviction shall be punished by a fine not to exceed $250.00. (Ord. 2894 § 2, 2005).
10.04.230 Limitations.
Nothing herein shall affect the provisions for metered parking control, pursuant to PTMC 10.04.150, nor shall it limit the power of the city police department to provide for “no parking” areas, limited parking areas, or traffic control for parades, street construction, emergencies or traffic control generally.
