12.56.010 Rules and regulations – City council authority.

The city council is authorized to make and adopt all rules and regulations necessary for use and enjoyment by owners of boats and other watercraft of the city boat haven, established and constructed by the city pursuant to Ordinance 863, passed and adopted October 10, 1949. (1958 code § 12.04.010)

12.56.020 Mooring without permit prohibited.

The owner, person in charge of, and any other person mooring or fastening any boat or other watercraft within the boat haven shall be guilty of a violation of this chapter unless he has a permit therefor, or unless within 24 hours he shall make application for and procure from the city clerk/treasurer a permit to moor or fasten such boat or watercraft therein. Any person who permits a boat or other watercraft to be or to remain in whole or in part on the float shall be guilty of a violation of this chapter. (1958 code § 12.04.030)

12.56.030 Permit – Application – Fee.

The owner or person in charge may secure a permit to moor boats or other watercraft in the city boat haven by making written application on forms furnished by the city and by paying in advance to the city clerk/treasurer for each permit $0.10 per foot or fraction thereof computed on the entire length or overall measurement of such boat or watercraft for each month or portion thereof stated in the application; provided, however, the minimum charge shall not be less than $2.00 per month or portion thereof. 12.56.040 Damaging dock, slip or float prohibited – Liability for repair costs.

Any person who destroys, defaces or damages the boat haven, or the dock, slip or float, or any part of either, shall be guilty of a violation of this chapter and, in addition to prosecution therefor, shall be required to repair the same; or, if the damage is repaired by the city, the person causing such damage shall be required to reimburse the city for all expenses incurred as a result of damage to the boat haven, float, and equipment. Upon order of the city council, the city attorney shall proceed in any proper court to seek reimbursement for the city’s cost incurred in such repairs. (1958 code § 12.04.040)

12.56.050 Inspection by chief of police.

The chief of police and members of his force, and any other officer or person appointed by the city council, shall make periodic inspection of the boat haven and shall enforce this chapter. (1958 code § 12.04.070)

12.56.060 Violation – Warrant of arrest issued upon complaint.

Upon written complaint charging a violation of this chapter filed with the police judge, he shall issue appropriate warrant of arrest for the person or persons charged in such complaint. (1958 code § 12.04.050)

12.56.070 Violation – Penalty.

Any person found guilty of a violation of this chapter shall be punished therefor by a fine of not less than $10.00 nor more than $100.00, or by imprisonment in the city jail for not less than one day nor more than 30 days, or by both such fine and imprisonment. (1958 code § 12.04.060)
