10.48.010 Definitions.

The definitions of off-road vehicle or “ORV” and other terms shall be as set forth in Chapter 46.09 RCW as the same exists now or may hereafter be amended. (Ord. 568 § 1 (part), 2006)

10.48.020 Permission to operate ORVs on city streets.

Pursuant to the provisions of state law, particularly those set forth in Chapter 46.09 RCW, except as otherwise provided in this chapter, and pursuant to the regulations set forth in this chapter, off-road vehicles (ORVs) may be operated on streets, roads, alleys and highways located in the city for purposes of plowing snow, performing agricultural related work, or for other outdoor work-related purposes and for commuting directly to and from work sites related to these purposes. 10.48.030 Maximum speed limit—Fifteen miles per hour.

The maximum speed of any ORV operated on city streets, roads, alleys, and highways shall be fifteen miles per hour. (Ord. 568 § 1 (part), 2006)

10.48.040 Restrictions related to operation of ORVs.

A.    Operation of ORVs shall be in compliance with all rules of the road applicable to motorized vehicles as set forth in Title 46 RCW and Chapter 308 WAC as the same exist now or may hereafter be amended, except as otherwise provided in this chapter.

B.    All operators of ORVs on city streets, roads, alleys and highways must be at least sixteen years of age and possess a valid vehicle driver’s license.

C.    Any operator of an ORV on city streets, roads, alleys or highways shall wear a safety helmet containing the insignias and requirements currently required for the operation of motorcycles on public streets, roads, alleys, and highways within the state of Washington.

D.    Every ORV operating within the city pursuant to this chapter shall, at all times from one-half hour after sunset to one-half hour before sunrise and any other time when, due to insufficient light or unfavorable atmospheric conditions, persons and vehicles on the highway are not clearly discernable at a distance of one thousand feet ahead, display lighted headlights and tail lights.

E.    Every ORV operated within the city shall at all times be assigned an ORV use permit and display a current ORV tag in accordance with the provisions of Chapter 46.09 RCW. (Ord. 568 § 1 (part), 2006)

10.48.050 Law enforcement compliance stops.

Law enforcement officers are authorized to stop any ORV operating upon a city street, road, alley, or highway to verify compliance with the ORV use permit and ORV tag requirements of Chapter 46.09 RCW and the provisions of this chapter. (Ord. 568 § 1 (part), 2006)

10.48.060 Penalty.

A.    The penalty provisions set forth in Chapter 46.09 RCW are adopted as the same exist now or may hereafter be amended to the extent said penalties are prescribed for violations of the provisions of Chapter 46.09 RCW.

B.    To the extent any violation of the terms of this chapter are not identified in Chapter 49.09 RCW, as violations of Chapter 46.09 RCW, all such violations shall be punished as civil infractions and subject the violator to a monetary penalty of not more than four hundred dollars. Community service hours may be imposed in lieu of a portion of the monetary penalty. (Ord. 568 § 1 (part), 2006)
