10.30.020 Application.
Application for any permit required by this ordinance works shall be made to the city engineer via submittal of a traffic study. The traffic study shall incorporate the following items:
(1) Haul routes;
(2) Number of trucks;
(3) Impacts to streets and intersections;
(4) Structural integrity of streets along truck route;
(5) Peak period impacts. [Ord. 134 § 5, 1995]
10.30.040 Over legal trucking operation.
If a permit is required by BMC 10.30.220, 10.30.240, 10.30.260, 10.30.280 or 10.30.300, such application shall contain a description of the object to be transported, or the vehicle or vehicles to be driven or used, the route desired to be traversed, the hours within which it is desired to perform the work, the means of locomotion to be used, and such other information as may be required. 10.30.060 Conditions of trucking permits.
The city engineer shall specify in permits issued pursuant to BMC 10.30.200, 10.30.220, 10.30.240, 10.30.260, 10.30.280 or 10.30.300, the routes to be traversed and the hours during which the operation may be undertaken, in accordance with the provisions of this division. [Ord. 134 § 5, 1995]
10.30.080 Moving, loading or parking operation.
If the application is for a permit to move, load, stand, park or angle park a vehicle contrary to the provisions of this division, such application shall show the location and explain the necessity for the operation, shall explain whether the operation may endanger other traffic or prevent it from using the street and such other information as may be required. 10.30.100 Conditions of loading or moving permit.
The city engineer shall authorize and specify in permits for loading or moving the hours under which the activity will be permitted, the manner in which it shall be performed, and shall outline any special precautions which may be required to protect the public. [Ord. 134 § 5, 1995]
10.30.110 Size, weight and load regulations.
Projects requiring continuous operations of vehicles with a gross weight of 18,000 pounds, including load, as specified in BMC 10.20.280, on city of Burien streets and rights-of-way other than those specified in BMC 10.40.060, shall obtain a special permit from the city authorizing and conditioning such continuous operations. Conditions may include, but are not limited to, establishing a portable or stationary scale at a specified location to weigh each truck and its load, restricted hours of continuous operation, restricted days of continuous operation, repair of road damage during continuous operation, reconstruction of streets before their use of continuous operations. Special permit fees shall be required to recover the cost of administration, monitoring, and enforcement of a special permit. (RCW 46.44.093) [Ord. 134 § 5, 1995]
10.30.120 Fee schedules.
The city of Burien shall adopt a schedule of fees for all permits issued pursuant to the trucking and parking regulations of this division. The fees shall be commensurate with the cost of administration, inspection, policing and roadway maintenance involved in the use of the streets and alleys within the city and shall, whenever possible, correspond with the fees specified in RCW 46.44.094, 46.44.095, and 46.44.096. Such schedule, when approved by the city council of the city of Burien by ordinance or resolution, shall govern the amount of the fee for such permit, and said fee shall be collected by the city as a condition to the issuance or continuance of any such permit. 10.30.140 Refunds for unused permits.
Whenever an overweight or overload permit has been issued and a fee paid therefor and either no rights are exercised pursuant thereto and such permit is surrendered or the fee charged is erroneous for any reason and application is made for refund, the city engineer shall certify the facts justifying such refund, the amount thereof, and his approval of such refund, and upon presentation of such certificate, the city manager is authorized to draw and pay a warrant on the general fund in the amount of such refund, and the necessary appropriations are hereby made from any balance in said fund. 10.30.200 Excess weight – Logging trucks – Special permits.
In addition to the limitations of BMC 10.20.260 through 10.20.440, a three-axle truck-tractor and a two-axle pole trailer combination engaged in the operation of hauling logs shall have an allowable variation in wheel base length of six feet for the distance between the first and last axle of the vehicle in combination which has a wheel base overall length of 37 feet or more and, upon special permit, the gross weight of two axles spaced less than seven feet apart may exceed by not more than 1,600 pounds the maximum gross axle weight specified for two axles spaced less than seven feet apart, being 32,000 pounds as provided in BMC 10.20.320, and the gross weight of the combination of vehicles may exceed by not more than 6,800 pounds the legal gross weight of the combination of vehicles, when licensed as permitted by law, for 68,000 pounds. Such additional allowances shall be permitted by a special permit issued in accordance with the provisions of RCW 46.44.047. (RCW 46.44.047) [Ord. 134 § 5, 1995]
10.30.220 Special permits for oversize or overweight movements.
A special permit in writing may be obtained from the city engineer upon application in writing and good cause being shown therefor, authorizing the applicant to operate or move a vehicle or combination of vehicles of a size, weight of vehicle or load exceeding the maximum specified in Chapter 10.20 BMC, or otherwise not in conformity with the provisions of Chapter 10.20 BMC upon any street or alley.
No overweight permit shall be issued to any vehicle or combination of vehicles unless such vehicle or combination of vehicles is licensed for the maximum gross weight allowed by law. (RCW 46.44.090) [Ord. 134 § 5, 1995]
10.30.240 Maximum gross weight – Special permit.
No special permit shall be issued for movement on any street or alley where the gross weight, including load, exceeds 22,000 pounds on a single axle or 43,000 pounds on any group of axles having a wheel base between the first and last axle thereof less than 10 feet; provided, that the weight limitations pertaining to single axles may be exceeded to permit the movement of equipment operating upon single pneumatic tires having a rim width of 20 inches or more and a rim diameter of 24 inches or more or dual pneumatic tires having a rim width of 16 inches or more and a rim diameter of 24 inches or more; provided further, that permits may be issued for weights in excess of the preceding limitations on streets or alleys that have been designed and constructed for weights in excess of such limitations; or the gross weight limitations may be waived when certification is made by military officials, or by officials of public or private power facilities that such movement or action is a necessary movement or action, and in the opinion of the city engineer the structures and street or alley surfaces on the routes involved are determined to be capable of sustaining weights in excess of such limitations. Application to waive or exceed gross weight limitations shall be made in writing on special forms provided by the city engineer, and shall be submitted at least 36 hours in advance of the proposed movement. 10.30.260 Special permits solo truck – Additional gross load – Fee.
When fully licensed to the maximum gross weight permitted under BMC 10.20.300 and 10.20.360 a two-axle truck or a three-axle truck operated as a solo unit and not in combination shall be eligible to carry gross weight in excess of that permitted for such a vehicle in BMC 10.20.300 and 10.20.360 upon the payment of a fee to the city engineer, as prescribed by BMC 10.30.120; provided, that the axle loads of such vehicles shall not exceed the limits specified in BMC 10.20.260 and the tire limits specified in BMC 10.20.420 or the wheel base requirements specified in BMC 10.20.440. 10.30.280 Special permits – Class A additional tonnage permits.
When fully licensed to a minimum gross weight of 72,000 pounds, a three or more axle truck-tractor, dromedary truck-tractor, or truck, operating in combination with another vehicle (the licensed gross weight of which, if any, shall be included when computing the minimum gross weights set forth above), shall be eligible, under special permits issued by the city engineer, to carry additional gross loads beyond the limit specified in BMC 10.20.360 upon the payment of a fee as specified in BMC 10.30.120. The axle loads of such vehicles shall not exceed the limits specified in BMC 10.20.260 or the tire limits specified in BMC 10.20.420. The gross weight of a three or more axle truck operated in combination with a two- or three-axle trailer shall not exceed 76,000 pounds, and the gross weight for a three or more axle truck-tractor operated in combination with semi-trailer shall not exceed 73,280 pounds except where the semi-trailer is eligible to carry a gross load of 36,000 pounds pursuant to the provisions of BMC 10.20.320 in which event the maximum gross weight of the combination shall not exceed 76,000 pounds. The minimum additional tonnage to be purchased pursuant to this section for a three or more axle tractor to be operated in combination with a semi-trailer shall be not less than 1,280 pounds. The permits provided for in BMC 10.30.260 and this section shall be known as Class A additional tonnage permits. (RCW 46.44.095) [Ord. 134 § 5, 1995]
10.30.300 Special permits – Class B additional tonnage permits.
In addition to the gross weight fees paid pursuant to RCW 46.16.070 and 46.16.115 and the gross weight permits issued pursuant to BMC 10.30.240, 10.30.260, and 10.30.280, and when a permit for the maximum gross weight permitted by law for a combination of vehicles has been purchased, a special permit for additional gross weight may be issued by the city engineer upon the payment of a fee as specified in BMC 10.30.120; provided, that the tire limits specified in BMC 10.20.420 shall apply, and the gross weight on any single axle shall not exceed 20,000 pounds and the gross lad on any group of axles shall not exceed the values shown in Table 1. 10.30.320 Special permits – Regulations.
The special permit provided for in BMC 10.30.260, 10.30.280 and 10.30.300 shall be used under such rules and regulations, and upon such terms and conditions consistent therewith, as may be prescribed by the city engineer. Such special permits shall entitle the permittee to carry such additional load in such an amount upon such streets or alleys as may be determined by the city engineer to be capable of withstanding such increased load without undue injury to the street or alley. 10.30.340 Special permit – Display.
Every special permit issued hereunder shall be carried in the vehicle or combination of vehicles to which it refers and shall be open to inspection by any peace officer or authorized agent of any authority granting such permit. (RCW 46.44.097) [Ord. 134 § 5, 1995]
10.30.350 Fire department permit – Display.
Every vehicle requiring a fire department permit shall carry a copy of the permit in the vehicle or combination of vehicles to which it refers and shall be open to inspection by any peace officer or authorized agent of the fire department. [Ord. 134 § 5, 1995]
10.30.360 State or county permits – Validity.
Trucks carrying overlegal loads to or from the city under valid state or county permit shall obtain a validation number for that state or county permit from the city engineer which will authorize operation to any destination within the city, by such route and at such time as the city engineer may prescribe. The validation number shall be noted on the back of the state or county permit by the operator and any peace officer checking this permit shall report the time, date, and validation number to the city engineer for determination of the validity of the operation. Violation of the terms of the validation will void the right of the permittee to further use of this privilege, and will require said permittee to obtain a written permit in the manner prescribed in this chapter.
