9.01.020 Principles of liability.

9.01.050 Penalties.

A.  Any person convicted of a gross misdemeanor shall be punished by a fine not to exceed five thousand dollars or by imprisonment in jail for a term not to exceed one year, or by both such fine and imprisonment.

B.  Any person convicted of a misdemeanor shall be punished by a fine not to exceed one thousand dollars or by imprisonment in jail for a term not to exceed ninety days, or by both such fine and imprisonment.

C.  Unless otherwise specifically defined as a gross misdemeanor, all violations of this title shall be deemed a misdemeanor. (Ord. 1457 §6, 1999).

9.01.060 Reward--Damage to city property.

A reward equal to ten percent of the dollar amount of the actual property damage (including cost of repair and replacement), but not less than fifty dollars and not to exceed one thousand dollars, resulting from any incident of property damage reported to the city shall be paid by the city to individual(s) providing information leading to the arrest and conviction of any individual or group of individuals for damaging city property when the information provided leads to the individual’s conviction for damage to city property.  When the city pays such a reward, the convicted individual(s) shall repay the reward amount to the city.  (Ord. 1457 §7, 1999).

9.01.070 Construction.

In adopting the state’s statutes by reference, only those crimes and offenses within the jurisdiction of a second-class city are intended to be adopted, and in those sections which deal with misdemeanors, gross misdemeanors and felonies, only the language applicable to misdemeanors and gross misdemeanors is to be applied.  (Ord. 1457 §8, 1999).

9.01.080 Severability.

If any section, sentence, clause or phrase of this title should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, sentence, clause or phrase of this title.  (Ord. 1457 §9, 1999).

9.01.090 Amendments to state statutes.

The amendment of any state statute (RCWs) and/or administrative code (WACs) adopted by reference in this title shall be deemed to amend the corresponding section of this title and it shall not be necessary for the city council to take any action with respect to such amendment.  (Ord. 1457 §10, 1999).
