13.10.010 Established.
The city of Edgewood hereby establishes a storm drainage and surface water management utility to provide for the future operation and control of storm drainage and surface water management within the city and hereby exercises jurisdiction and control thereof. (Ord. 96-15 § 1).
13.10.020 Fund created.*
The city of Edgewood hereby establishes a surface water management fund and adopts by reference Chapter 11.02 PCC, Storm Drainage and Surface Water Management, and as may be subsequently amended, and hereby exercises the authority to receive all those fees relating to the operation of said storm drainage and surface water management utility which are due or are being collected or are to be collected. 13.10.030 Powers authorized.
The city of Edgewood hereby elects to exercise all lawful powers and authority for the construction, acquisition, and condemnation of property rights, maintenance, management, operations and regulation of storm drainage and surface water runoff systems including, without limitation, all lawful powers to fix, alter, regulate, and control the charges and conditions of the use thereof. (Ord. 96-15 § 3).
13.10.040 Limitation of liability.
The city does not assume responsibility or control over past actions for loss or damages which have occurred and which may occur as a result of the operation of the existing storm drainage and surface water management system by Pierce County and disclaims any responsibility therefor. (Ord. 96-15 § 4).
13.10.050 Interlocal agreement.
The city manager is hereby directed and authorized to develop an interlocal agreement with Pierce County for the transfer of all assets and fund balances pertaining to said storm water utility now lying with the city of Edgewood or those which are necessarily part of the system, or alternatively, to develop an interlocal agreement for the mutual operation and support of the storm drainage and surface water management utility by the city of Edgewood and Pierce County lying within the drainage basins. 13.10.060 Fees – Collection authority.
The city manager is hereby directed and authorized to collect the storm drainage and surface water management fees imposed hereunder in an orderly manner, by an agreement with Pierce County or the Pierce County assessor. (Ord. 96-15 § 6).
13.10.070 PCC 11.02.050(A) amended – Method of calculating service charges.
An annual service charge schedule is hereby established for all areas of the city.
A. Annual service charges for all parcels within the city are as follows:
1. Residential: $40.00.
2. Duplex: $51.60.
3. Multifamily: $0.01515 per square foot of impervious area.
4. All mobile homes other than subsection (1) of this section: $22.075/vacant or occupied mobile home site (mobile home equivalent), plus $0.01515 per square foot of impervious area in addition to mobile home site.
5. Vacant/undeveloped: $0.20/acre, but in no case shall the minimum service charge be less than $10.00/parcel.
6. Forest and timber land: $10.00 per parcel, plus $0.002/acre on lands classified as forest lands under Chapters 84.33 and 84.34 RCW.
7. State, county and federal public highways: $0.00454 per square foot of impervious area.
8. All parcels other than subsections (1) through (7) of this section: $0.01515 per square foot of impervious area but in no case shall the minimum service charge be less than the higher of the residential equivalent rate for each year or the charge for a vacant/undeveloped parcel of equal acreage. 13.10.080 Council approval.
The city manager is hereby directed to present to the city council for their final approval the agreements for the continued operation of the storm drainage and surface water management utility within the city of Edgewood and for the collection of the fees thereof. (Ord. 96-15 § 7).
