4.17.040 Regulating planting strips.

It is unlawful for any person other than the city of Ellensburg, through its authorized representative, to dig in or under the surface of, or to in any manner disturb the surface of, any planting strip in or along any improved street or highway in the city of Ellensburg, Washington, having street curb construction by or through the authority of the city of Ellensburg, except in planting flowers or in leveling, and filling for, and the placing of, grass suitable for lawn thereon, by sodding or resodding, or by seeding or reseeding the same at sidewalk level; or in the planting of trees therein as hereinafter provided, or in cutting or trimming of grass or grass-sod thereon in necessary care or culture thereof, or the necessary rooting or removal of weeds or growth other than grass or trees therefrom; provided, that said provisions shall not apply to any person having authority under any franchise from the city of Ellensburg, or when necessary in repairing pipelines now existing or in making necessary pipe connections, to dig in or disturb such planting strip so as to do as little damage as possible to grass or trees growing thereon, and shall restore the same to the same condition in which it was before the digging and disturbance of said planting strip commenced. 4.17.080 Depositing rubbish prohibited.

It is unlawful for any person to deposit or cause to be deposited upon any planting strip described in ECC 4.17.040 any refuse, waste or any substance foreign to the purpose of such planting strips. [Ord. 2947 § 1, 1973; Ord. 2917 § 2, 1972.]

4.17.120 What may be planted.

It is unlawful for any person to plant or maintain in any planting strip described in ECC 4.17.040 any growth of any kind other than flowers, shade trees, and grass suitable to lawn, and no trees shall be set out, planted or maintained in any such planting strip described in ECC 4.17.040, except such varieties as shall be designated by the Ellensburg city arborist, nor shall any such tree be set other than at the distance apart or distance from trees existing on such planting strip as such city arborist may order. 4.17.160 Definition.

“Person,” as used in this chapter, includes individuals, corporations and associations. [Ord. 2917 § 4, 1972.]

4.17.200 Penalty.

Any person violating any of the provisions of this chapter shall upon conviction thereof be punished by a fine of not more than $300.00. [Ord. 2917 § 5, 1972.]
