9.05.010 Purpose.

This chapter identifies other governing documents to be used in conjunction with Chapters 9.05 through 9.92 ECC. [Ord. 4549 § 2, 2009; Ord. 4503 § 2, 2007.]

9.05.020 Definitions.

“City” means the city of Ellensburg, Washington.

“City gas codes and practices” means the document produced by the city to comply with state and federal laws concerning the operation and maintenance of gas systems.

“Ellensburg Municipal Code” means the codified ordinances adopted by the Ellensburg city council.

“Energy services director” means the energy services director or any energy services department employee authorized by the energy services director to act on his or her behalf.

“National Electric Safety Code” means the most current version of the National Electric Safety Code.

“Public works development standards” means the standards developed by the public works department that establish the guidelines and procedures for the water, sewer, storm sewer, street system and other associated topics administered by the public works department.

“Public works director” means the public works director or any public works department employee authorized by the public works director to act on his or her behalf. [Ord. 4503 § 2, 2007.]

9.05.030 General.

The directors of their respective utilities shall have authority to render administrative interpretations of the provisions contained in this title and to promulgate rules, policies and procedures to carry out the purposes of this title so long as such rules, policies, interpretations and procedures are not inconsistent herewith. Copies of all standards and governing documents will be available from the city clerk. [Ord. 4503 § 2, 2007.]

9.05.100 Electric standards and governing documents.

The construction, maintenance and operation of the electric utility shall be in conformance with the Ellensburg Municipal Code; public works development standards; National Electric Safety Code and other state and federal laws as applicable. [Ord. 4503 § 2, 2007.]

9.05.200 Gas standards and governing documents.

The construction, maintenance and operation of the gas utility shall be in conformance with the Ellensburg Municipal Code; public works development standards; city gas codes and practices and other state and federal laws as applicable. [Ord. 4503 § 2, 2007.]

9.05.300 Sewer standards and governing documents.

The construction, maintenance and operation of the sewer utility shall be in conformance with the Ellensburg Municipal Code; public works development standards; city’s comprehensive sewer plan; Washington State Department of Transportation Standard Specifications for Road, Bridge, and Municipal Construction; Washington State Department of Ecology Criteria for Sewage Works Design; and other state and federal laws as applicable. 9.05.400 Water standards and governing documents.

The construction, maintenance and operation of the water utility shall be in conformance with the Ellensburg Municipal Code; public works development standards; city comprehensive water plan; city’s “Cross-Connection and Backflow Policy and Procedure”; Washington State Department of Transportation Standard Specifications for Road, Bridge, and Municipal Construction; and other state and federal laws as applicable. 9.05.500 Penalties.

A.    Notice of Violation. In case of any violation of any of the provisions of this title, the department director may cause a written notice thereof to be served on the owner or occupant of the premises where such violation takes place, which notice shall require the payment of the charges provided in this title, and if such charges be not paid within 24 hours from the time of the service of such notice, the utility may be turned off from such premises and shall in no case be turned on until the charges have been paid.

B.    Enforcement of Ordinance and Report. It shall be the duty of all the employees to assist the department directors in the enforcement of the provisions of this title, and to this end they shall report all violations thereof which come to their knowledge to the appropriate department director, and it shall be the duty of the fire marshal to report immediately to the public works director in the case of fire in premises having service for fire protection purposes, that fire has occurred therein.

C.    Copies of Codified Ordinance. A copy of the ordinances codified in this title may be obtained by all owners of the property and consumers of utilities, and shall be considered a part of the contract made between the city and every such owner and consumer.

D.    Violations. Unless otherwise provided for in this title, it shall be a civil infraction for any person to violate the provisions of this title. Any person who commits a civil infraction under this title shall be assessed a penalty and default amount not to exceed $250.00, not including statutory assessments. Every person convicted of a misdemeanor under this title shall be punished by imprisonment in jail for a maximum term fixed by the court of not more than 90 days, or by a fine in an amount fixed by the court of not more than $1,000, or by both such imprisonment and fine. Each day’s violation constituting an infraction or misdemeanor shall be a separate offense. [Ord. 4503 § 2, 2007.]
