9.04.010 Short title.

This chapter and Chapters 9.08 through 9.84 GMC shall be referred to and known as the “city penal code.” (Ord. 2007-18 § 2).

9.04.020 Definitions.

For the purposes of this penal code, the words and phrases set forth in this section shall have the following meanings:

A. “Delinquent child” means “juvenile offender” as that term is defined in RCW 13.40.020(15).

B. “Dependent child” means any child under the age of 18 years of age who meets the definition of “dependent child” as set forth in RCW 13.34.030(5).

C. “Probationer” means any person who, after conviction of a violation of a city ordinance, has been placed on probation in connection with the suspension or deferral of sentence by either the Grandview municipal court or the Yakima County superior court on appeal. (Ord. 2007-18 § 2).

9.04.030 Costs of prosecution.

Whenever anyone is convicted of an offense under any section of this penal code, or section of any other city ordinance, in addition to any fine imposed, he may be required to pay the costs of prosecution. (Ord. 2007-18 § 2).

9.04.040 Violation of probation – Arrest.

Whenever a duly commissioned police officer of the police department has probable cause to believe that a probationer, prior to the termination of the period of his probation, is, in such officer’s presence, violating or failing to comply with any requirement or restriction imposed by the court as a condition of such probation, such officer shall cause the probationer to be brought before the court wherein sentence was deferred or suspended, and for such purpose the police officer may arrest the probationer without warrant or other process. 9.04.050 General requirements of culpability.

RCW 9A.08.010, General requirements of culpability, is hereby adopted by reference. (Ord. 2008-26 § 1).

9.04.060 Violation – Penalty.

Except as otherwise specifically provided herein, any person violating this penal code or any section or provision thereof is guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding $1,000 or by imprisonment not to exceed 90 days, or by both such fine and imprisonment. Any crime designated as a gross misdemeanor shall be punishable by a fine not exceeding $5,000 or by imprisonment not to exceed 365 days, or by both such fine and imprisonment. (Ord. 2007-18 § 2).

RCW 9.94A.030 is hereby adopted by reference as it relates to misdemeanors, gross misdemeanors and criminal street gangs. (Ord. 2008-26 § 2).

9.04.080 Liability for conduct of another – Complicity.

RCW 9A.08.020, Liability for conduct of another, is hereby adopted by reference. (Ord. 2008-26 § 3).
