8.08.010 Purpose.

The purpose of this chapter is to eliminate potentially dangerous accumulations of combustible materials and to assist the City in eliminating unlawful, unnecessary and indiscriminate burning. (Ord. 1725 § 1, 1986).

8.08.020 Outdoor burning – Permits.

No outdoor burning shall be permitted within the City limits except as provided in IMC 8.08.030 and when a permit for the same has been issued by the Fire Department unless such fire is exempt pursuant to IMC 8.08.050. (Ord. 1725 § 1, 1986).

8.08.030 Permit – Types of fires.

A permit may be issued pursuant to this chapter for the following types of fires within the City limits.

A. Fires for the destruction of natural vegetation which has been cut and stacked as a result of a single, residential yard cleanup;

B. Fires for ceremonial rites or large outdoor gatherings involving a controlled bonfire. (Ord. 1725 § 1, 1986).

8.08.040 Permit – Application.

A. To obtain a permit required by this chapter, the applicant shall file an application with the Fire Department which shall include:

1. The type of materials to be burned;

2. The location of the fire;

3. The individual(s) designated as being responsible for controlling the fire;

4. A signed statement by the applicant stating he will follow all outdoor burning regulations contained in this code, including Chapter 16.06 IMC, that no outdoor burning shall be left unattended or permitted later than 1 hour after sunset, and that he will provide protection against fire spread in a manner approved by the Fire Chief.

B. No fee shall be required to obtain an outdoor burning permit.

C. All such permits shall be available for inspection throughout the period of time the permit is issued and burning is in progress.

D. The Fire Department shall establish an effective period for the permit which period shall not exceed 30 days. Any outdoor burning conducted after such date shall require a separate permit.

E. Regardless of any established permit period, the Fire Department shall have the authority to forbid, restrict or suspend any and all burning when the Fire Chief has determined that weather conditions are unfavorable or hazardous for outdoor fires. (Ord. 1725 § 1, 1986).

8.08.050 Exemptions.

The following types of outdoor fires are exempt from the permit process:

A. Contained cooking fires;

B. Fire in outdoor firepits or fireplaces. (Ord. 1725 § 1, 1986).

8.08.060 Penalty.

Any person violating any of the provisions of this chapter shall be deemed to have committed a civil offense and shall be subject to the penalties established pursuant to IMC 1.06.010(B). (Ord. 1725 § 1, 1986).
