A. To achieve compliance with this chapter, the Director is authorized to carry out enforcement and/or abatement actions pursuant to IMC 13.28.130 and 13.28.135 or other provisions provided by law.

B. The Director shall gain compliance with this chapter by requiring the implementation of source control BMPs and, when necessary, AKART. Initial compliance will be defined in the site inspection report prepared by the City, including expected dates of compliance, subject to reinspection.

C. Upon failure to comply with the inspection report recommendation and compliance date, the Director is authorized to issue orders requiring source control measures in accordance with IMC 13.28.130. Failure to effect such source control measures constitutes a violation of this chapter, and the penalties provided in Chapter 8.45 IMC may be enforced against the person or persons holding title to the subject property served by the facility.

D. The Director is authorized to make such inspections, including the inspection of source control inventory sites, and take such actions as may be required to enforce the provisions of this chapter. (Ord. 2989 § 1 (Exh. A1), 2022).
