5.74.010 Purpose.

The provisions of this chapter shall be deemed an exercise of the power of the city to obtain reimbursement for certain costs incurred and be consistent with the provisions of Article 8 Section 7 of the Constitution of the state. (Ord. 2439 § 1 (part), 1979)

5.74.020 Fee schedule established for payment to the city of Kirkland costs of certain services rendered by the city.

Persons seeking and obtaining the following services as provided by the city shall pay the following amounts for each instance such service is provided:

(1)    Police department, fingerprinting: five dollars;

(2)    Applicants for all entry level positions requiring qualifying examinations whether such positions are covered by civil service or otherwise shall reimburse the city for the per capita cost charged to the city by the appropriate testing agency for the giving of such qualifying examinations. Qualifying examinations may include physical agility testing or similar performance testing as well as written examinations. The fee shall be paid to the city at the time of filing application; provided, that a declaration of indigency by the applicant under this subsection shall excuse the imposition of the fee. 5.74.030 Fees not refundable.

No portion of any fee requested to be paid pursuant to this chapter shall be refunded or refundable, provided that a fee may be refunded when a refund request is made to the city prior to the city having incurred any cost or expended effort in complying with the request for that service giving rise to the fee. 5.74.035 Concurrency review and appeals.

Fees for concurrency management review and appeals shall be as set forth in Section 5.74.070 of this chapter. (Ord. 3830 § 2, 2002: Ord. 3675 § 5, 1998)

5.74.040 Fees charged by the public works department.

When the public works department provides engineering review or inspections services, and a fee for such service is not published, the applicant shall pay the following rate for such services:

(b)    Whenever any construction work, public improvement or other activity is required or permitted to be performed upon any public right-of-way, or within or upon any property which, upon completion of said work or activity, is to be conveyed or dedicated as public right-of-way or public easement, the city shall not accept for maintenance or otherwise such work, improvement, facility or activity until there has been paid to the city by the person required or permitted to perform such work or activity an amount equal to a percent of the estimated cost of construction of such work, improvement, facility or activity as and for reimbursement to the city for its cost of review and inspection of such work, improvement, facility or activity. In addition, prior to the release of any permit for construction of storm drainage collection and conveyance on private property, the permit applicant shall pay a percent of the estimated cost of construction of such work, improvement, facility or activity as reimbursement to the city for its cost of review and inspection of such work, improvement, facility or activity. Estimated cost of construction shall be determined by the director of the department of public works. Whenever such a review and inspection fee is required, the public works department is authorized to collect up to one-half of the fee at permit application with the remainder being due at permit issuance.

(c)    This section shall not apply to:

(1)    Work performed under public works construction contracts let by the city pursuant to Chapter 3.85; or

(2)    So much of such work performed under a developer’s extension agreement (Chapter 35.91 RCW facilities agreement) as is determined by the director of public works to be for the benefit of the Kirkland water or Kirkland sewer system rather than for the benefit of the property being concurrently subdivided, developed or improved by the signors to the developer extension agreement.

(d)    The director is authorized to interpret the provisions of this chapter and may issue rules for its administration. This includes, but is not limited to, correcting errors and omissions and adjusting fees to match the scope of the project. The fees established here will be reviewed annually, and, effective January 1st of each year, may be administratively increased or decreased by an adjustment, rounded to the nearest dollar, based upon either the current published annual change in the Seattle Consumer Price Index for Wage Earners and Clerical Workers, the city’s actual experience with materials and labor costs during the preceding year, or the most recent Construction Cost Index published by the Engineering News-Record as needed in order to maintain the cost recovery objectives established by the city council.

(e)    MyBuildingPermit.com Surcharge. In addition to the fees listed in this section there shall be a surcharge collected to pay for the city’s MyBuildingPermit.com membership fees and to help offset the cost of the enhancements and maintenance of the MyBuildingPermit.com and permit tracking software.

Exception: The MyBuildingPermit.com surcharge does not apply to the following:

(1)    Water meter installation.

(2)    Water billing.

(3)    Sewer discharge and penalties.

(4)    Sewer billing.

(5)    Street cut fees.

(6)    City trees or civil penalties. 5.74.045 Utility/lien search fees for property closings.

For each request for service received by the city of Kirkland the following listed fee(s) shall be charged and imposed:

5.74.050 Returned check fee.

Whenever a check presented to the city is returned for a reason such as insufficient funds, or an order for stop payment, the maker shall be charged a fee of twenty-five dollars. Any license or application paid for with such check is invalid, and any penalty paid for with such check is still outstanding. The twenty-five-dollar fee and any costs in excess of twenty-five dollars actually incurred in collecting checks of this nature shall be added to the amount required to be paid. This provision is in addition to any remedy the city has against the maker of the check personally. (Ord. 3724 § 1, 1999: Ord. 3459 § 1 (part), 1995: Ord. 3044 § 1 (part), 1987)

5.74.060 Recovery of collection costs.

Whenever this code or an ordinance or regulation of the city provides that a person is to pay a certain fee or charge, in the event of nonpayment for thirty days after the amount is due and owing, such person shall also pay the city’s reasonable costs of collection and ten percent per annum interest on the delinquent amount. The collection costs and interest will be added to the original amount due which will not be considered paid until the new total is paid in full. 5.74.070 Fees charged by planning and building department.

(a)    The schedule establishes fees charged by the planning and building department. The entire fee must be paid before the review or processing begins, except as otherwise specified. (b)    The director of finance and administration is authorized to interpret the provisions of this chapter and may issue rules for its administration. This includes, but is not limited to, correcting errors and omissions and adjusting fees to match the scope of the project. The fees established will be reviewed annually and, effective January 1st of each year, may be administratively increased or decreased, by an adjustment to reflect the current published annual change in the Seattle Consumer Price Index for Wage Earners and Clerical Workers as needed in order to maintain the cost recovery objectives established by the city council.

(c)    MyBuildingPermit.com Surcharge. In addition to the fees listed in this section there shall be a surcharge collected to pay for the city’s MyBuildingPermit.com membership fees and to help offset the cost of the enhancements and maintenance of the MyBuildingPermit.com and permit tracking software.

5.74.080 Schedule for payment of fees and other charges for processing certain development applications.

5.74.090 Expedited review.

Upon the request of a permit applicant, the planning and building department may approve expedited processing of an application. An expedited processing schedule may be approved only if no other permit application will be delayed. The planning and building department may contract for permit review services to prevent such delays. Any additional costs incurred by the city due to expedited processing shall be paid by the permit applicant as an increase in the permit application fee. 5.74.100 Conflicts.

This chapter will control over all previous rules, ordinances, or resolutions that conflict with the fees as established in this chapter. (Ord. 3675 § 7, 1998)
