9A.20.010 Unlawful carrying of a weapon.
(1) It is unlawful for anyone on or in any premises in the city of Kittitas where alcoholic beverages are dispensed by drink to carry any knife or other cutting or stabbing instrument, with a blade length of four or more inches, whether said weapon is concealed or not.
(2) It is unlawful for anyone on or in any premises in the city of Kittitas where alcoholic beverages are dispensed by the drink to carry any firearm, rifle, or handgun, whether or not said person has a license or permit to carry a concealed weapon.
(3) It shall be unlawful for anyone to carry, exhibit or display or to draw any firearm, sword, dagger, knife or other cutting or stabbing instrument, club, or any other weapon, apparently capable of producing bodily harm, in a manner, under circumstances, and at a time and place that either manifests an intent to intimidate another or that warrants alarm for the safety of other persons.
(4) Exceptions.
(a) Any lawful act committed by a person while in his place of abode or fixed place of business;
(b) Any person who by virtue of his office or public employment is vested by law with a duty to preserve public safety, maintain public order, or to make arrests for offenses, while in the performance of such duty whether during regular duty hours or not;
(c) Any person acting for the purpose of protecting himself against the use of presently threatened unlawful force by another, or for the purpose of protecting another against the use of such unlawful force by a third person;
(d) Any person making or assisting in making a lawful arrest for the commission of a felony.
(5) Any person violating these provisions shall be guilty of a misdemeanor. Any and all weapons shall be confiscated. (Ord. 97-539 § 2).
9A.20.020 Unlawful use of a weapon.
(1) It shall be unlawful for any person, firm or corporation to display, sell, give away, purchase or possess any dirk, dagger, stiletto, snap-blade knives, blackjack, sap or metal knuckles in the city of Kittitas, provided this section shall not apply to the possession of any such weapons by any police or military officer authorized by proper authority to carry the same in the course of his duties as such police or military officer.
For purposes of this section, “snap-blade knives” shall mean any knife having a blade which is or can be confined or concealed in its handle and ejected therefrom either manually or by a mechanical or spring device and shall not apply to fixed blade knives or knives having blades which pivot on and fold into their respective handles and can be opened only manually.
(2) Any weapons named in subsection (1) of this section found in the possession of any person convicted of violation of the provisions of this chapter shall be confiscated by the chief of police, or any officer acting in his duty or authority.
(3) It shall be unlawful for any person to carry upon his person any concealed weapon consisting of either a revolver, pistol, or other dangerous weapon; provided, that this section shall not apply to police or military officers and other persons whose duty it is to execute process of warrants or make arrests and to persons duly authorized by license granted to state law.
(4) It shall be unlawful for any person to carry upon his person or to have in his possession, concealed or openly, any weapon, revolver, pistol, or other dangerous weapon in any tavern, cocktail lounge, restaurant or any other business in the city of Kittitas, at any time, unless an officer of the law or military in the performance of his duty.
(5) It shall be unlawful for any person to fire or discharge any gun, pistol, revolver, BB gun, airgun, or any firearm of any description in the city of Kittitas, except in the lawful defense of his person or property or in the performance of his duties as a police officer or military.
(6) No minor under the age of 16 years of age shall handle or have in his possession or under his control, except while under the accompaniment of or under the immediate charge of his parent or guardian, any firearm of any kind.
(7) Any person violating this chapter shall be guilty of a misdemeanor. (Ord. 97-539 § 2).
