1.16.010 General penalties.

A. Criminal Penalty. Unless otherwise provided, any person violating any of the provisions or failing to comply with any of the mandatory requirements of this code is guilty of a misdemeanor. Any person convicted of a misdemeanor under this code shall be punished by a fine not to exceed $5,000 or by imprisonment not to exceed one year, or by both such fine and imprisonment.

B. Civil Penalty. Any person violating or failing to comply with any of the mandatory requirements of this code which is designated a civil offense shall have committed a civil infraction. Any such person shall be assessed a monetary penalty not to exceed $250.00 for each day that the violation occurs.

1.16.020 Separate offense.

Each person as specified in MCMC 1.16.010 is guilty of a separate offense for each and every day during any portion of which any violation of any provision of this code is committed, continued or permitted by any such person, and he is punishable accordingly.

1.16.030 Additional remedies.

In addition to the penalties provided by MCMC 1.16.010 and 1.16.020, any condition caused or permitted to exist in violation of any of the provisions of this code is a public nuisance and all remedies given by law for the prevention and abatement of nuisances shall apply regardless of any institution or imposition of criminal remedies stated above.
