9A.05.010 Criminal penalties.

(1) Every person convicted of what is designated as a gross misdemeanor in this title shall be punished by imprisonment for a maximum term fixed by the court of not more than one year, or by a fine in an amount fixed by the court of not more than $5,000, or by both such imprisonment and fine.

(2) Every person convicted of what is designated as a misdemeanor in this title shall be punished by imprisonment for a maximum term fixed by the court of not more than 90 days, or by a fine in an amount fixed by the court of not more than $1,000, or by both such imprisonment and fine. 9A.05.020 Civil infractions.

(1) Except as provided in subsection (2) of this section, and unless otherwise provided, every person found to have violated a provision of this title designated as a civil infraction shall be punishable by a fine of $100.00. The court may also order a person found to have committed a civil infraction to make restitution.

(2) Any provision of this title wherein the violation of the provision constitutes a civil infraction designated as a class 1 civil infraction, class 2 civil infraction, class 3 civil infraction, or class 4 civil infraction, shall be subject to the penalties and restitution set forth in RCW 7.80.120. For the purposes of this subsection, RCW 7.80.120 is adopted as if set forth in full herein as now enacted or hereafter amended. (Ord. 2701 § 7, 2001).
