11.32.010 Definitions.

“Master permit” means the agreement in whatever form whereby a city or town may grant general permission to a service provider to enter, use, and occupy the right-of-way for the purpose of locating facilities. This definition does not limit, alter, or change the extent of the existing authority of the city to require a franchise, nor does it change the status of a service provider asserting an existing state-wide grant based on a predecessor telephone or telegraph company’s existence at the time of the adoption of the Washington State Constitution to occupy the right-of-way. For the purposes of this definition, a franchise, except for a cable television franchise, is a master permit. A “master permit” does not include cable television franchises.

“Telecommunications service provider” means every corporation, company, association, joint stock association, firm, partnership, person, city, or town owning, operating, or managing any facilities used to provide and providing telecommunications or cable television service for hire, sale, or resale to the general public. “Service provider” includes the legal successor to any such corporation, company, association, joint stock association, firm, partnership, person, city or town. 11.32.020 Application for master permit.

Telecommunications service providers may make application for a master permit by filing the following written information to the city clerk:

(1) Name of service provider requesting master permit.

(2) Location of business address.

(3) Name and address of business agent seeking master permit.

(4) Detailed description of the telecommunications services to be offered within the city. Such description shall be in sufficient detail so that the city will be informed of the specific type of telecommunications services being proposed.

(5) Detailed description of the proposed telecommunications facility and infrastructure sought to be located in the city’s right-of-way, which shall identify whether the facility and infrastructure is to be located above or below ground, and whether shared use of facilities, such as shared conduits, is envisioned.

(6) A list of the rights-of-way and a map showing where facilities are proposed to be located pursuant to the master permit, together with a schedule for build-out to the entire franchise area.

(7) A list of all cities in Washington where the applicant has obtained a franchise.

(8) Such other and further information reasonably necessary for the city to evaluate the application as a whole. (Ord. 2653 § 1, 2000).

11.32.030 Approval of master permit.

Upon filing and submittal of all of the information listed in PMC 11.32.020 in a form satisfactory to the city, the application shall be deemed complete, and the city shall process the application and approve the master permit upon successful negotiation of a franchise ordinance. In the event that the city adopts a general telecommunications ordinance or any other ordinance concerning the issuance of a master permit, the master permit will be issued upon the service provider’s full compliance with all of the terms of such future ordinances.
