17.42.010 Code adopted by reference.

There are adopted by reference upon the effective date of the ordinance codified in this chapter the standards hereafter set forth. A copy of each of the city codes has been placed on file in the office of the city clerk. Future amendments to the standards established hereafter shall automatically become a part of this section upon publication:

(1) City Standards for Public Works Engineering and Construction.

(2) 1991 Standard Specifications for Roads, Bridges, and Municipal Construction published by the Washington State Department of Transportation and American Public Works Association. (Ord. 2376 § 3, 1993).

17.42.020 Conflict of standards.

In case of conflict between codes enumerated in PMC 17.42.010, the first named code shall govern. (Ord. 2376 § 3, 1993).

17.42.030 Applicability of standards.

The provisions of this chapter and the City Standards for Public Works Engineering and Construction and the 1991 Standard Specifications for Roads, Bridges, and Municipal Construction shall be applicable to and govern in the following cases:

(1) Contracts for public improvements awarded by the city in all cases except those cases in which a federal or state master contract shall be in conflict with the City Standards for Public Works Engineering and Construction or with the 1991 Standard Specifications for Roads, Bridges, and Municipal Construction, and in such cases the provisions of the particular federal or state contract shall govern and shall be binding upon the city and the contractor;

(2) Contracts for any public improvements within the public right-of-way, easements, and city properties;

(3) Operations of any public improvements within the public right-of-way, easements and city properties;

(4) Projects on private property, relating to utilities, which are connected to the basic city utility system. (Ord. 2376 § 3, 1993).

17.42.035 Expiration of applications, approvals or permits.

(1) Expiration of Application. Project applications that are subject to SEPA review shall be governed by applicable SEPA deadlines. All other applications shall expire by limitation if no permit or approval is issued within 180 days after the city determines that the application is complete, unless the city determines that a project proponent has pursued issuance of a permit or approval in good faith. The city may extend the time for action on the application for one or more periods, each period not exceeding 90 days, upon written request by the applicant showing good cause. If an application has expired, plans and other data previously submitted for review may thereafter be returned to the applicant, except that the city shall retain originals or copies in order to comply with applicable record retention laws. In order to renew action on an expired application, the applicant shall resubmit plans and pay a new review or application fee.

(2) Expiration of Permits or Approvals. All permits or approvals shall expire by limitation and become void if:

(a) Work authorized by the permit or approval is not commenced within 180 days of approval or permit issuance;

(b) Work is suspended or abandoned for 180 days or more after work is commenced; or

(c) After two years from the date of permit or approval issuance, regardless of whether work is finished.

The building official is authorized to grant one or more extensions of time for periods not more than 180 days each. The extensions shall be requested in writing and justifiable cause demonstrated.

If a permit or approval expires, the city may issue a new permit or approval for the unfinished work upon a showing of good cause and payment by the project proponent of half of the original permit or approval fee. However, if any applicable law, regulation or rule has materially changed after the expiration of the permit or approval, the city shall have full discretion to decline to issue a new permit even upon a showing of good cause. The option for approval or permit renewal shall lapse two years after the permit or approval expires.

(3) This section shall apply to permits and approvals issued under PMC Titles 11, 14 and 21, and applications for such permits or approvals. (Ord. 2962 § 7, 2010).

17.42.040 City Standards for Public Works Engineering and Construction manual.

The “City Standards for Public Works Engineering and Construction” manual has been prepared to provide a graphic and written representation of minimum standards for construction of public improvement within the public right-of-way, easement, city properties, and on private property relating to utilities which are connected to the utility systems maintained by the city of Puyallup. The application of the city standards has been coordinated with the “1991 Standards Specifications for Road, Bridge, and Municipal Construction” prepared by the Washington State Department of Transportation and the American Public Works Association. Revision, or additional specifications may be prepared from time to time by the engineering division, and shall become a part of this chapter. A copy of the City Standards for Public Works Engineering and Construction which has been prepared or revised shall be placed on file in the office of the city clerk. (Ord. 2376 § 3, 1993).

17.42.050 Copies for sale.

(1) A complete copy of the City Standards for Public Works Engineering and Construction may be purchased for $100.00 plus sales tax from the engineering division of the city of Puyallup. Individual copies of pages may be purchased for $0.50 each. When a complete copy is purchased and registered with the engineering division, the owner will be eligible to receive updates with revision or additions at no charge until December 31, 1998. The updates will be mailed out to the registered owners on a quarterly basis or may be picked up at the same location as purchased. It shall be the responsibility of the individual to check with engineering division to verify that the standards being used are the most current on file.

(2) Also available for purchase are AUTOCAD drawing files of the city standard details on diskettes. A complete set of the details on diskette may be purchased for $70.00 plus sales tax. Individual details on diskette may be purchased for $2.00 plus sales tax each. Also, the engineering division has prepared AUTOCAD detail sheets laid out to fit on a 24-inch x 36-inch plot. The AUTOCAD detail sheets contain all of the details available individually. There are five groups of details. Each group may be purchased for $20.00 plus sales tax. An increases of charges for these copies may be made upon approval of the city council without amending this section. (Ord. 2376 § 3, 1993).
