FAIR PARKING OVERLAY ZONE

20.47.000 Fair parking overlay zone.

The following FPO fair parking overlay zones are established. Properties so designated shall be subject to the provisions contained in this chapter:

RS-FPO    Single-family residential, fair parking overlay zone

RM-FPO    Multiple-family residential, fair parking overlay zone

20.47.005 Description and purpose.

The FPO zones are intended to apply to those properties under the ownership of the Western Washington Fair Association which are contiguous to the Western Washington Fairgrounds and constitute the primary surface parking lots associated with the fairgrounds. The FPO overlay zones are intended to allow certain events and uses both associated with and independent from fairground activities which can only be staged in large contiguous open areas while ensuring that such uses are no more disruptive to existing residential uses than is necessary, as consistent with the comprehensive plan. 20.47.010 Permitted uses and conditionally permitted uses – FPO zones.

(1) Regulations governing uses in the underlying zones shall apply to properties in the FPO overlay zone;

(2) Vehicular parking associated with events occurring at the fairgrounds;

(3) Periodic motor vehicle sales in areas not more than 600 feet distance from a CG zone subject to development and performance standards:

(a) No more than six motor vehicle sales shall be held in any given calendar year. Such sales events shall be conducted no more frequently than one event per month for a duration not to exceed three consecutive days, not including the associated time for moving vehicles on and off the parking areas. Hours for moving vehicles are limited from 8:00 a.m. to 5:00 p.m.;

(b) The location for motor vehicle sales shall be alternated such that the events may occur no more frequently than once every two months in either of the contiguous parking areas bounded by streets;

(c) Any temporary tent enclosure shall be located in areas not farther than 200 feet away from the CG zone or the FAIR zone;

(d) Sound amplifiers shall not be permitted;

(e) Motor vehicle sales activities shall cease after 8:00 p.m.;

(f) A minimum number of available parking spaces shall be required on-site as calculated according to PMC 20.55.010(1). (For example, for one acre of open sales area a minimum of 51 spaces shall be required);

(4) Special events/activities including, but not limited to, carnivals, circuses, flea markets and revival meetings subject to the following development and performance standards:

(a) Special events shall be allowed no more frequently than three days during any three-month period; provided, that events/activities conducted during the annual fall fair are exempt from and do not apply to this restriction;

(b) Any temporary tent or similar enclosure shall be located in areas not farther than 200 feet away from the CG zone or the FAIR zone; provided, that for special events/activities conducted during the annual fall fair, any tent or similar enclosure shall be located no closer than 400 feet to an adjoining residential zone lacking the FPO zone classification;

(c) A minimum number of available parking spaces shall be required on-site as calculated according to PMC 20.55.010(1); provided, that events/activities conducted during the annual fall fair shall be exempt from parking requirements;

(d) Maximum building height shall be as defined in PMC 20.37.020(3) for events/activities conducted during the annual fall fair; for events/activities conducted at all other times, maximum building height shall be as specified in the underlying zone;

(e) Special events/activities are not exempt from and shall comply with the provisions of Chapter 6.16 PMC regarding noise control;

(5) Community recreational activities;

(6) Maintenance operations and buildings incidental to and associated with the fairgrounds;

(7) Recreational vehicle parking and occupancy use associated with the fall or spring fair, including associated set-up and take-down time in the RS-08-FPO zone;

(8) Recreational vehicle parking and occupancy use associated with event at the fairgrounds other than the fall or spring fair or community-wide events subject to the following development and performance standards:

(a) The number of vehicles shall be restricted to 100 vehicles in the RM-20-FPO zone and 750 in the RS-08-FPO zone per event.

(b) Vehicles may be parked for a period of time not exceeding four days in duration in the RM-20-FPO zone and not exceeding seven days in duration in the RS-08-FPO zone per event. (Ord. 2506 § 1, 1997; Ord. 2454 § 1, 1995).

20.47.015 Administrative conditional use – FPO zones.

The following uses are administrative conditional uses in the respective FPO overlay zones. An administrative conditional use permit pursuant to Chapter 20.80 PMC shall be required and in full force and effect in order to establish said uses:

(1) Recreational vehicle parking and occupancy use associated with events at the fairgrounds in the RM-20-FPO zone for more than 100 vehicles or exceeding four days in duration per event;

(2) Recreational vehicle parking and occupancy use associated with events at the fairgrounds in the RS-08-FPO zone for more than 750 vehicles or exceeding seven days in duration per event. (Ord. 2506 § 1, 1997; Ord. 2454 § 1, 1995).

20.47.020 Property development and performance standards – FPO zone.

The following development and performance standards shall apply to properties located in the FPO zone in addition to the development and performance standards specified for the underlying zones:

(1) Landscaped Setbacks. There shall be a 15-foot landscaped yard setback along all FPO boundaries that are common with any property which is zoned RS, RM or PDR and does not contain a FPO zone designation.

(2) Required Landscaping. Wherever landscaping is required by this title or by conditions of approval of discretionary permits, such landscaping shall be permanently maintained in a neat and orderly manner. In no event shall such areas be used to store materials or park vehicles.

(3) Parking Setbacks. Where required landscaped setbacks have not been installed, there shall be a 15-foot setback where no parking of vehicles is permitted along all FPO boundaries that are common with any property which is zoned RS, RM or PDR and does not contain a FPO zone designation.

(4) Trash Receptacles. Permanent trash receptacles having a capacity in excess of one cubic yard shall be screened from view from adjacent properties and public rights-of-way. All such receptacles shall be set back at least 15 feet from any property which is zoned RS, RM or PDR and does not contain a FPO zone designation and shall be maintained in a neat and sanitary condition.

(5) Outdoor Lighting. Floodlighting shall be shielded to confine direct illumination within the property boundaries.

(6) Generators. Generators for recreational vehicles shall only be operated between the hours of 7:00 a.m. to 8:00 p.m. on weekdays and between 8:00 a.m. to 9:00 p.m. on weekends. (Ord. 2506 § 1, 1997; Ord. 2454 § 1, 1995).
