25.05.010 Purpose.

(1) The purpose of this title is to implement the Shoreline Management Act of 1971 and to provide for the regulation of development that impacts those areas of the City of Sammamish under the jurisdiction of the Shoreline Management Act consistent with the policies of Section 2 of that Act, Chapter 173-16 WAC, and the goals, policies and objectives of the City’s shoreline management master program.

(2) This title contains the regulations of the City’s shoreline management master program and the procedures to implement those regulations. These regulations and procedures are consistent with and implement the goals, policies, and objectives of the City’s shoreline management master program that are contained in a separate document and adopted by ordinance. 25.05.020 Citation.

This title shall be known as the shoreline management code. (Ord. O99-29 § 1)

25.05.030 Scope.

(1) No development shall be undertaken by any person on the shorelines of the state unless such development is consistent with the provisions of this title and the goals, policies, and objectives of the master program.

(2) Development prohibited by this title but otherwise permitted by the City’s land use controls is prohibited only within the shorelines of the state.

(3) Development proposed on property adjacent to water bodies or wetlands under the jurisdiction of the Shoreline Management Act shall be evaluated in terms of the goals, policies and objectives of the master program. (Ord. O99-29 § 1)

25.05.040 Liberal construction.

This title is exempted from the rule of strict construction and shall be liberally construed to give full effect to the objectives and purposes for which it was enacted. (Ord. O99-29 § 1)

25.05.050 Relationship to other City regulations.

(1) When provisions of this chapter conflict with the sensitive areas code, Chapter 21A.50 SMC, that which provides more protection to the sensitive area shall apply.

(2) The City of Sammamish shall issue no permit prior to approval pursuant to this title and shall take no action contrary to the goals, policies, objectives and regulations of the City’s shoreline management master program when property under the jurisdiction of the Shoreline Management Act is involved in a request for a decision in any of the following programs:

(a) Building permit;

(b) Right-of-way construction permit;

(d) Grading permit;

(e) Site plan approval;

(f) Access permit;

(g) Trail permit;

(h) State flood control zone permit;

(i) Zoning variance;

(j) Conditional use permit;

(k) Comprehensive plan amendment or addition;

(l) Zone reclassification;

(m) Special use permit;

(n) Subdivision approval;

(o) Mobile home park permit;

(p) Mobile home permit;

(q) Recreational vehicle park permit; and

(r) Commercial site development permit. (Ord. O99-29 § 1)
