SKAGIT COUNTY FLOOD CONTROL ZONE DISTRICTS

Sections:

6.36.010    Skagit County Flood Control Zone District.

6.36.020    Sedro-Woolley Sub-Flood Control Zone.

6.36.030    Dunbar Road Sub-Flood Control Zone.

6.36.040    South Mount Vernon Sub-Flood Control Zone.

6.36.010 Skagit County Flood Control Zone District.

Skagit County Flood Control Zone District is declared to be duly organized.

This countywide district shall have all the powers, authorities and duties provided in R.C.W. 86.15, et seq., and any and all amendments thereto.

The boundaries of said district are hereby established as follows:

Commencing at midchannel of Rosario Strait where the dividing line between Townships 36 and 37 intersects the same; thence E on said Township line to the summit of the Cascade Mountains; thence S along the summit of said mountain range to the eighth (8th) standard parallel; thence W along the parallel to the center of the channel or deepest channel of the nearest arm of Puget Sound and extending along said channel to the E entrance of Deception Pass; thence through said pass to the center of the channel of Rosario Strait; thence N along said channel to place of beginning.

EXCEPTING and DELETING from said description the following described area, to wit:

Commencing at a point where the N line of Section 28, Township 36 N, R 3 E.W.M. intersects the line of ordinary high tide on the shore of Bellingham Bay; thence from said point extending E along the N line of said Section 28, and Section 27, to the W line of the right-of-way of the Great Northern Railway Company; thence in a S direction along the W line of said right-of-way to a point where said right-of-way intersects the E line of the SE 1/4 of the NW 1/4 of said Section 27; thence S through the center of said Section 27 to the S line thereof; thence E to the NW corner of the NE 1/4 of the NE 1/4 of Section 34; thence S through the center of the NE 1/4 of Section 34 to the NW corner of the NE 1/4 of the SE 1/4 of said Section 34 thence E along the N line of the NE 1/4 of the SE 1/4 of said Section 34 to the E line thereof; thence S along the E line of said Section 34 to the SE corner thereof; thence W along the S line of said Section 34 to the center of that certain slough known as Edison Slough; thence following along the center of said slough in a W direction to a point where said slough intersects the W line of Section 33 thence N along said W line of Section 33 to a point where said Section line intersects the shoreline of Bellingham Bay; thence following said shoreline of said Bellingham Bay in a NE direction to the place of beginning; all of said description being in Township 36 N, R 3 E.W.M., Skagit County, Washington. 6.36.020 Sedro-Woolley Sub-Flood Control Zone.

There is created and duly organized the Sedro-Woolley Sub-Flood Control Zone Within the County-wide Flood Control Zone.

The boundaries of said sub-flood zone are hereby established as follows:

Beginning at the corner common to Sections 13 and 24, Township 35 N, R 4 E.W.M. and Sections 18 and 19, Township 35 N, R 5 E.W.M., this point also beginning at a point in the intersection of State Highway 9 and the McGarigle Road. Thence NE along the centerline of the McGarigle Road to the E city limits of the City of Sedro-Woolley. Thence S along said City Limits to the centerline of Highway 20. Thence W along said Highway 20 to the Intersection of Highway 9; thence N along Highway 9 to the Point of Beginning.

Beginning at the NE 1/4 of Section 27, Township 35 N, R 4 E.W.M.; thence S along the Section line between Section 27 and 26 to a point that is on the S line of the NE 1/4 of the NE 1/4 of said Section 27; this point also being the true point of beginning; thence W along said S line to a point that is 15 feet E of the line running between the SE 1/4 of the NE 1/4 and the SW 1/4 of the NE 1/4 of said Section 27; thence S and parallel to said line a distance of 360.94 feet; thence S 18° 17′ E to the N right-of-way line of the Burlington Northern Railroad; thence NE along said line to the intersection of the S line of the NE 1/4 of the NE 1/4 of Section 27, Township 35 N, R 4 E.W.M.; then E along said line to the true point of beginning.

Beginning at the Section corner, common to Sections 7, 8, 17 and 18 of Township 35 N, R 5 E.W.M.; thence W along the N line of Section 18, to the center of the Fruitdale Road No. 9111; thence N and W, along said Fruitdale Road to the center of the Kalloch Old Grade Connection Road No. 9114; thence W along said Kalloch Old Grade Connection Road to the center of secondary State Highway 9; thence S along said S.S.H. #9 to the center of the Bassett Road No. 6345 and the corner common to Sections 7 and 18 of Township 35 N, R 5 E.W.M. and Sections 12 and 13 of Township 35 N, R 4 E.W.M.; thence W and SW along said Bassett Road to a point on the W line of the E 1/2 of the SE 1/4 of the NW 1/4 of Section 13, Township 35 N, R 4 E.W.M. thence S along said W line to a point on the E-W centerline of said Section 13; thence W along the E-W centerline of said Section 13 to a point on the E right-of-way line of Burlington Northern Railroad; thence S and E along said right-of-way line to a point on the N line of the S 3/4 of the S 1/2 of the SW 1/4 of said Section 13; thence W along said N line, to a point on the W line of said Section 13; thence S along said W line to the corner common to Sections 13, 14, 23 and 24 of Township 35 N, R 4 E.W.M.; thence S along the line between Sections 23 and 24 to a point on the N line of the S 1/2 of the N 1/2 of Section 23, Township 35 N, R 4 E.W.M.; thence W along said N line to a point on the W line of Section 23; thence S to the S right-of-way line of the Cook Road; thence E to a point that is 165 feet W of the W 1/2 of the NW 1/4 of the SW 1/4 of Section 23; thence S and parallel with the W line of the Section 264 feet; thence E and parallel with the N line of said NW 1/4 of the SW 1/4 165 feet to the E line of the W 1/2 of the NW 1/4 of the SW 1/4; thence along said line to the S line of the NW 1/4 of the SW 1/4 of Section 23; thence W along said line to the line running between Section 23 and 22, Township 35 N, R 4 E.W.M.; thence S along said line to the corner common to the Sections 22, 23, 26 and 27, Township 35 N, R 4 E.W.M.; thence S along the line between Sections 26 and 27 to a point that is on the S line of the NE 1/4 of the SE 1/4 of Section 27, Township 35 N, R 4 E.W.M.; thence W along said line to a point that is 15 feet E of the line running between the SE 1/4 of the NE 1/4 and the SW 1/4 of the NE 1/4 of said Section 27; thence S and parallel to said line a distance of 360.94 feet; thence S 18° 17′ E to the N right-of-way of the Burlington Northern Railroad; thence N and E along said right-of-way line to a point on the E line of Section 24, Township 35 N, R 4 E.W.M.; thence N along said E line to a point in the center of the State Route 20; thence E along the centerline of State Route 20 to the E city limits of Sedro-Woolley; thence N along said city limits to a point in the center of the McGarigle Road; thence NE along said McGarigle Road to a point on the W line of the NE 1/4 of the NW 1/4 of the SE 1/4 of Section 18, Township 35 N, R 5 E.W.M.; thence S along said W line to a point on the S line of the NE 1/4 of the NW 1/4 of the SE 1/4 of said Section 18; thence E along said S line to a point in the center of the Fruitdale Road No. 9111; thence N along the centerline of said Fruitdale Road to the point of intersection with the McGarigle Road; thence NE along the centerline of said McGarigle Road and said centerline produced N and E to a point on the E line of Section 18, Township 35 N, R 5 E.W.M.; thence N along said E line to the point of beginning.

EXCEPTING and DELETING from said description the following described area, to wit:

The W 1/2 of the NW 1/4 of the SW 1/4 of Section 23, Township 35 N, R 4 E.W.M., EXCEPT the right-of-way for State Highway along the N side thereof and EXCEPT the following described tract: Beginning at the NE corner of said W 1/2 of the NW 1/4 of the SW 1/4; thence W on the N line of said subdivision 165 feet; thence S and parallel with the W line of the Section 264 feet; thence E and parallel with the N line of said NW 1/4 of the SW 1/4 165 feet to the E line of said W 1/2 of the NW 1/4 of the SW 1/4; thence N 264 feet to the point of beginning.

6.36.030 Dunbar Road Sub-Flood Control Zone.

There is created and duly organized the Dunbar Road Sub-Flood Control Zone within the County-wide Flood Control Zone.

The boundaries of said sub-flood zone are hereby established as follows:

Beginning at a point in the center of the Dunbar Road No. 4520, 742.50 feet W of the SE corner of Section 13, Township 34 N, R 3 E.W.M.; thence W along the centerline of said Dunbar Road 238.90 feet to a point on the W line of the E 981.4 feet of the SE 1/4 of the SE 1/4 of Section 13; thence N along said W line, 425 feet; thence W 214 feet; thence S 40 feet; thence W 235 feet; thence N 52° 06′ W, 265 feet; thence S 17° 04′ W, 220 feet more or less, to a point in the center of S.S.H. No. 536; thence S 52° 06′ E, along the centerline of said S.S.H. No. 536, 495 feet more or less to a point on the W line of the SE 1/4 of the SE 1/4 of said Section 13, thence S along said W line and the W line of the NE 1/4 of the NE 1/4 of Section 24, Township 34 N, R 3 E.W.M., 232 feet more or less to the SW corner of Lot 1 of the Conn-Lind Addition, as recorded in Volume 7 of Plats, Page 25, Records of Skagit County, Washington; thence E along the S line of Lot 1, 129 feet to the SE corner of said Lot 1; thence N and E, along the E line of said Lot 1, and the E line extended N, 116 feet more or less to a point in the center of S.S.H. No. 536; thence S 52° 06′ E, along the centerline of said S.S.H. No. 536, 515 feet more or less to a point on the W line of the E 742.50 feet of the NE 1/4 of the NE 1/4 of said Section 24, thence N along said W line, 410 feet more or less to the point of beginning. 6.36.040 South Mount Vernon Sub-Flood Control Zone.

There is created and duly organized the South Mount Vernon Sub-Flood Control Zone within the Countywide Flood Control Zone.

The boundaries of said sub-flood zone are hereby established as follows:

Beginning at a point where the centerline of Blackburn Road intersects with the centerline of the Burlington Northern Railroad; said point being on the E-W centerline of Section 30, Township 34 N, R 4 E.W.M.; thence S along the centerline of the Burlington Northern Railroad to a point where the centerline of the Burlington Railroad intersects the S line of said Section 30; thence continuing S along the centerline of the Burlington Northern Railroad 1820 feet. Thence E on a line parallel to the S line of the NE 1/4, NE 1/4, of Section 31, Township 34 N, R 4 E.W.M., to a point on the E line of said Section 31, said point being the centerline of Old Highway “99” S; thence continuing E on a line parallel to the S line of the NW 1/4, NW 1/4, Section 32, Township 34 N, R 4 E.W.M., to a point where said line intersects with the centerline of Interstate Highway No. 5; thence N along the centerline of Interstate Highway No. 5 to a point where said centerline intersects with the centerline of Blackburn Road. Said point being on the E - W centerline of Section 29, Township 34 N, R 4 E.W.M., thence W along the centerline of Blackburn Road to the Point of Beginning. (Res. 6245, 1974, 41 CJ 242)
