"Disabled" means qualified persons with a disability as that term is defined by the federal Fair Housing Act Amendments, 42 USC Section 12131(2), 42 USC 3602(h) and (i) and 42 USC Section 12210(b)(1) and (2). The term includes persons with a handicap as that term is defined by applicable federal and state law as the same exists or is hereafter amended. A handicap is:

(1) a physical or mental impairment which substantially limits one or more of a person’s major life activities;

(2) a record of having such an impairment; or

(3) being regarded as having such an impairment.

The term disabled includes alcoholics and recovering drug addicts but does not include those who currently and illegally use controlled substances. (Added by Amended Ord. 04-010, Mar. 3, 2004, Eff date Mar. 15, 2004).
