5.16.010 Definitions.

The following definitions shall apply to this chapter.

A. “Social card game” means social card game as defined in RCW 9.46.0282, as now existing or hereafter amended, which constitutes gambling and is authorized by the Washington State Gambling Commission under RCW 9.46.070. Social card games may include a house-banked or a player-funded banked card game. “Social card game” as used in this chapter also includes all other activities that constitute gambling which are authorized or licensed by the Washington State Gambling Commission under RCW 9.46.070, as now existing or hereafter amended, to the extent that said activities include any gambling activity engaging in the use of, or associated with, any other mechanical or electronic mechanism including but not limited to video terminals, as authorized pursuant to RCW 9.46.0282 and 9.46.0217, as now existing or hereafter amended.

B. “Commercial stimulant” means commercial stimulant as defined in RCW 9.46.0217, as now existing or hereafter amended, and includes a licensed gambling activity authorized by the Washington State Gambling Commission, when the activity is operated in connection with an established business with the purpose of increasing the volume of sales of food or drink for consumption on the business premises.

C. “Gambling” means gambling as defined in RCW 9.46.0237, as now existing or hereafter amended. [Ord. 2047 § 1, 2002.]

5.16.020 House-banked social card games prohibited.

Any license issued under the authority of State law to engage in any gambling activity shall be legal authority to engage in those gambling activities for which the license was issued throughout the City, except that the City, in accordance with RCW 9.46.295, as the same now exists or may hereafter be amended, prohibits the conduct or operation of house-banked social card games as a commercial stimulant, as defined in RCW 9.46.0217 and 9.46.0282.
