6.04.010 Purpose.

The purpose of this chapter is to control animal noise in a manner which promotes commerce; the use, value and enjoyment of property; sleep and repose; and the quality of the environment. (Ord. 542 § 1, 1994).

6.04.020 Animal noises constituting a public disturbance.

It is unlawful for any person possessing or owning an animal or fowl to allow to originate from the property sounds or combination of sounds which unreasonably disturb or interfere with the peace, comfort or repose of another for more than 15 minutes in any one-hour period of any day, and is documented by three or more separate episodes of such noise in a sequential seven-day period. These would include loud and raucous, or frequent repetitive, or continuous sounds created by animals or fowl, such as barking, howling, braying, quacking or crowing. Noise from animals which during the hours of 10:00 p.m. and 7:00 a.m. may be heard 50 feet from the perceived property line shall be deemed excessive and in violation of this section. During the hours of 7:00 a.m. and 10:00 p.m. this distance shall be extended to 100 feet. It is an affirmative defense under this section if the animal was intentionally provoked by another person to make such noise. (Ord. 828 § 1, 2021; Ord. 736 § 1, 2013; Ord. 542 § 1, 1994).
