Chapter 9.50 PARKING AND RULES OF THE ROAD

A. Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic-control device, no person shall park a vehicle, whether occupied or not, except temporarily for the purpose of and while actually engaging in loading or unloading property or passengers:

1. Within fifty feet of the nearest rail or a railroad crossing;

2. Within an alley in a residence district in such a manner or under such conditions as to leave available less than ten feet of the width of the roadway for the free movement of vehicular traffic, and no person shall stop, stand, or park a vehicle within an alley in such position as to block the driveway entrance to any abutting property; provided, that it is lawful for the operator of a vehicle to park so as to leave available less than ten feet of width, or so as to block the alley in a residence district if necessary, only while the vehicle is actually engaged in construction, repair, service functions, or expeditious loading or unloading which could not otherwise be performed;

3. In an alley, in a business district; provided, that a properly marked truck or vehicle may park or stand in alleys in a business district for such time, not in excess of thirty minutes, as may be necessary for the expeditious loading or unloading of such vehicles, or utilized in construction, repair, or service functions, or the delivery or picking up of property; provided further, that such vehicle shall not be parked in an alley in a business district so as to leave available less than ten feet of width unless such functions could not otherwise be performed; and further provided, that for the purposes of this subsection the term “properly marked vehicle or truck” means either a vehicle regularly used in the performance of a function therein described and clearly identified as such with its firm name printed thereon, or a vehicle being used in performance of a function therein described and displaying a sign of at least fifteen inches by four inches in size in both the front and back windows conspicuously identifying its function and indicating the name of the firm or the function being performed; or

4. At any place where official signs prohibit parking.

B. No person shall move a vehicle not lawfully under his control into any prohibited area or away from a curb such a distance as is unlawful. (Ord. 2023-036 § 1, 2023; Ord. 95-46 § 1, 1995).

9.50.015 Obedience to signs and markings.

Upon those streets which have been signed or marked for angle parking, parallel parking or center street parking, no person shall park or stand a vehicle in any manner other than that indicated by such signs or markings and no person shall stand or park any portion of a vehicle outside the confines of such markings. 9.50.020 Motorcycle parking.

It is unlawful to park any vehicle other than a motorcycle in a parking stall designated by markings on the pavement within that stall as one for motorcycle parking only. (Ord. 2023-036 § 1, 2023; Ord. 2735 § 2 (part), 1983).

9.50.040 Parking of certain vehicles prohibited on certain streets.

When signs are erected giving notice thereof, no person shall park a vehicle as herein specified and as specified on such sign at any time upon any street where such sign is erected and herein specified as follows:

1. Motor trucks bearing a licensed gross weight, in accordance with RCW 46.16.170, in excess of ten thousand pounds:

a. Both sides of North 1st Street between “B” Street and “I” Street;

b. The east side of North 1st Street from a point one hundred fifteen feet south of Sycamore Street to a point one hundred sixty feet north of Sycamore Street;

c. The north and south sides of “E” Street between 1st Street and Front Street;

d. The east side of Front Street two hundred feet south and two hundred feet north of “E” Street;

e. Both sides of 11th Street south of “A” Street; and

f. Both sides of 4th Avenue between Lincoln Avenue and “B” Street. (Ord. 2023-036 § 1, 2023; Ord. 98-46 § 1, 1998: Ord. 2735 § 2 (part), 1983).

9.50.050 Parking prohibited at all times on certain streets.

When signs are erected giving notice thereof, no person shall park a vehicle at any time upon any of the following streets:

(1) Both sides of 3rd Street from its intersection with Arlington Street north to its intersection with South 2nd Street and the west side of South 3rd Street from the intersection of South 2nd Street northerly to the intersection of Pacific Avenue;

(2) The east side of 1st Street from Sycamore Street to Tamarack Street and from Lincoln Avenue to “I” Street; and the west side of 1st Street from Tamarack Street to a point two hundred fifty feet south of “I” Street, and from Race Street south to Pacific; and both sides of 1st Street from Tamarack Street to Interstate 82; and from Pacific Street to the south city limits except on the west side from a point three hundred feet south of Arlington to a point five hundred feet south of Arlington;

(3) The east side of 3rd Avenue from a point seven hundred fourteen feet north of Division Street south to a point three hundred seventy-three feet north of Prasch Avenue, and from King Street to Washington Avenue; and the west side of 3rd Avenue from a point six hundred ninety-two feet north of Division Street south to the south city limits;

(4) Both sides of 5th Avenue from “B” Street to Lincoln Avenue and the east side of 5th Avenue from Walnut Street south to a point three hundred feet south of Spruce Street, and from Pine Street to Queen Anne Boulevard; and the west side of 5th Avenue from Walnut Street to a point two hundred thirty feet south of Tieton Drive, and from Division Street to Nob Hill Boulevard; and the east side of 5th Avenue from one hundred feet north of Fruitvale Boulevard to Quince Street, and from a point two hundred ninety feet north of West “D” Street to a point one hundred twenty feet south of Cherry Avenue;

(5) The east side of 7th Avenue from Yakima Avenue to Chestnut Avenue, and from Pine Street to Tieton Drive;

(6) Both sides of 11th Avenue from Walnut Street to Spruce Street and the west side of 11th Avenue from Tieton Drive north to the Yakima Valley Transportation Company railroad tracks and the east side of 11th Avenue between Walnut Avenue and Yakima Avenue;

(7) Both sides of 16th Avenue within the city limits except the east side from twenty feet south of Nob Hill Boulevard to three hundred twenty feet south thereof;

(8) The east side of 24th Avenue from Nob Hill Boulevard to Viola Avenue, and from a point one hundred fifty feet south of Logan Avenue to Washington Avenue; and the west side of 24th Avenue from Nob Hill Boulevard to a point one hundred feet south of Clinton Way, and from a point twelve hundred feet north of Washington Avenue to Washington Avenue;

(9) Both sides of “I” Street from 1st Street to 5th Avenue;

(10) Both sides of “F” Street from 8th Street one-half block east to alley;

(11) Both sides of Lincoln Avenue from 4th Street to 1st Street, and from 10th Street to 8th Street, and from 5th Avenue to 40th Avenue, and from 24th Avenue to 40th Avenue; and north side of Lincoln Avenue from 44th Avenue to 46th Avenue; and the south side of Lincoln Avenue from 16th Avenue to 24th Avenue and from 46th Avenue to Bitterroot Way;

(12) Both sides of “B” Street from 4th Street to Naches Avenue and from 8th Street to 10th Street; the north side of “B” Street from Naches Avenue to 8th Street; and both sides of “B” Street from Pierce Avenue to 6th Avenue;

(13) The north side of “A” Street from 16th Avenue to Hall Avenue, and from 4th Street to the alley one-half block west thereof; and the south side of “A” Street from Naches Avenue to 3rd Street;

(14) The north side of Summitview Avenue from 7th Avenue to Pierce Avenue, and from a point two hundred eighty feet west of the west curb of Pierce Avenue to a point one hundred eighty feet west of Custer Avenue, and from forty feet west of 15th Avenue to 31st Avenue, and from 32nd Avenue to the west city limits; and the south side of Summitview Avenue from 7th Avenue to 33rd Avenue, and from three hundred eighty feet east of 39th Avenue to the west city limits;

(15) Both sides of Yakima Avenue from 8th Street to 9th Street, and from Front Street west to the railroad tracks, and from Chicago Avenue to 22nd Avenue; and the south side of Yakima Avenue from 1st Street to a point one hundred fifty feet east of 1st Street, and from 12th Avenue to Chicago Avenue;

(16) Both sides of Chestnut Avenue from 12th Avenue to 15th Avenue, and from 16th Avenue to 20th Avenue; and the south side of Chestnut Avenue from 6th Avenue to 12th Avenue (except for indented angle parking located between 10th Avenue and the loading zone opposite South 9th Avenue), and except that parking on both sides of Chestnut will be allowed on Sundays between 6th and 9th Avenues and between 11th and 12th Avenues from six a.m. to one p.m. and from 20th Avenue to Stanley Boulevard;

(17) The east side of Stanley Boulevard from Chestnut Avenue to 23rd Avenue; and the west side of Stanley Boulevard from Laban Avenue to a point six hundred ten feet south;

(18) Both sides of Walnut Street from 1st Street to 3rd Avenue, and from 6th Avenue to 11th Avenue; and the north side of Walnut Street from 6th Street to Naches Avenue and from 3rd Avenue to the alley west of 4th Avenue, and the south side of Walnut Street from the alley east of 4th Avenue to the alley west of 4th Avenue, and the south side of Walnut Street between 28th Avenue and 30th Avenue, and the north side of Walnut Street from 28th Avenue to a point four hundred eighty feet west;

(19) The north side of West Spruce Street from Holton Avenue to 12th Avenue;

(20) Both sides of Tieton Drive from 5th Avenue to the west city limits except the north side from 8th Avenue to 9th Avenue;

(21) Both sides of Nob Hill Boulevard from the east city limits to the west city limits;

(22) Both sides of Mead Avenue from 10th Street to Voelker Avenue and from 1st Avenue to 16th Avenue; and the north side of Mead Avenue from Voelker Avenue to 1st Avenue;

(23) Both sides of Washington Avenue from a point four hundred feet east of 1st Street to 3rd Avenue; and both sides of Washington Avenue from 16th Avenue to Spring Creek Road;

(24) The east side of 7th Street from “G” Street to “H” Street;

(25) The east side of Pierce Avenue from Summitview Avenue to West Lincoln Avenue; and the west side of Pierce Avenue from Lincoln Avenue to Folsom Avenue;

(26) Both sides of 40th Avenue from the north city limits to the south city limits except on the west side of 40th Avenue from one hundred ninety feet north of Summitview Avenue to two hundred ninety feet north of Summitview Avenue;

(27) Both sides of LaSalle Street from 9th Street to 10th Street (Fair Avenue);

(28) The south side of Belmont Avenue from 15th Avenue to 16th Avenue;

(29) Both sides of Knobel Avenue;

(30) The east side of North 4th Avenue from Cherry Avenue to a point three hundred fifty feet south thereof;

(31) The east side of 8th Street from “A” Street to Yakima Avenue;

(32) The west side of 10th Street from Pacific Street to Nob Hill Boulevard and the east side of 10th Street between “A” Street and Fair Avenue;

(33) The north side of Prasch Avenue from 13th Avenue to 16th Avenue; and the south side from one hundred feet east of 15th Avenue to 16th Avenue;

(34) The west side of South 29th Avenue from West Chestnut Avenue to West Walnut Street;

(35) The north side of Pitcher Street between 10th Street and Fair Avenue;

(36) The south side of Terrace Street from 14th Avenue to a point one hundred sixty feet east thereof;

(37) North side of “I” Street from North 4th Street westerly to the north-south alley between North 4th Street and North 3rd Street;

(38) South side of Arlington Street from South 40th Avenue to South 42nd Avenue;

(39) East side of North 31st Avenue between Summitview Avenue and Barge Street;

(40) South side of Haynes Street between Pleasant Avenue and Queen Avenue;

(41) Both sides of South 15th Avenue from its intersection with Nob Hill Boulevard southerly a distance of two hundred feet;

(42) The north side of Arlington from 9th Street to 10th Street (Fair Avenue);

(43) The south side of Central Avenue from 8th Street to 10th Street (Fair Avenue);

(44) Both sides of Spring Creek Road;

(45) The west side of 48th Avenue from four hundred feet north of Tieton Drive to three hundred twenty feet south of Tieton Drive and on the east side from three hundred feet north of Tieton Drive to four hundred feet south of Tieton Drive;

(46) Both sides of 30th Avenue from Tieton Drive to a point three hundred ninety-five feet north of Walnut Street;

(47) Both sides of 6th Street from its intersection with Nob Hill Boulevard to two hundred seventy feet north of Nob Hill Boulevard;

(48) Both sides of Fair Avenue between North 10th Street and Pacific Avenue;

(49) Both sides of 18th Street between Nob Hill Boulevard and Pacific Avenue;

(50) Both sides of Pacific Avenue between 18th Street and Fair Avenue;

(51) The north side of Pacific Avenue between Fair Avenue and 9th Street;

(52) Both sides of Kern Road between North 40th Avenue and East Powerhouse Road;

(53) Both sides of North 39th Avenue between Kern Road and Castlevale Road;

(54) Both sides of Castlevale Road from North 40th Avenue to the east five hundred thirty feet;

(55) The east side of South 3rd Street from the northeast corner of East Chestnut Street to a point one hundred seventy-five feet north of East Chestnut Street; and the north side of East Chestnut Street from the northeast corner of South 3rd Street to a point two hundred feet east of the northeast corner of South 3rd Street;

(56) Both sides of East Walnut Street from South 1st Street to a point one hundred sixty feet east of South 3rd Street;

(57) Both sides of South 28th Avenue between Tieton Drive and Walnut Street;

(58) The north side of King Street from the intersection of South First Street to a point six hundred twenty-five feet west. 9.50.065 Parking time limits.

A. Parking time limits for streets and city-owned lots shall be at the discretion of the city manager.

B. It shall be a violation of this chapter to exceed a parking time limit when signs are erected in each block of the street with a parking time limit giving notice thereof or in a city-owned parking lot when signs are erected in the parking lot giving notice of the parking time limit.

C. Parking time limits for streets and city-owned lots, as well as permit-only parking restrictions in the city-owned parking lots identified in YMC 9.50.215, shall be in force between the hours of eight a.m. and six p.m., Monday through Friday, with the exception of the following holidays:

9.50.085 Stopping, standing, or parking prohibited in specified places.

(1) Except when necessary to avoid conflicts with other traffic, or in compliance with law or the directions of a police officer or official traffic-control device, no person shall stop, stand or park a vehicle:

(a) On any part of a sidewalk at any time; or

(b) Within the vision clear view triangle defined in YMC 15.05.040, at any time; or

(d) Within ten feet of a clearly visible mailbox which is located directly adjacent to a curbside or on a public right-of-way, between the hours of eight a.m. and five p.m., except on Sundays and holidays. 9.50.100 Truck parking in residence districts restricted.

No vehicle exceeding in length twenty feet shall be parked on any street in any residential district for a period exceeding one hour continuous time, except for the expeditious loading or unloading of articles or materials. (Ord. 2023-036 § 1, 2023; Ord. 2735 § 2 (part), 1983).

METHODS OF PARKING

9.50.130 Angle parking.

The front wheel of a vehicle angle parked at a curb shall touch the curb immediately in front of such vehicle. Such a vehicle shall be parked in such a manner that the entire width of such vehicle is located within the stall or parking space designated by such lines; provided, however, that no vehicle the overall length of which exceeds twenty feet shall angle park. All angle parking, including center-street angle parking, shall be head-in parking unless otherwise signed, or marked or authorized by permit. (Ord. 2023-036 § 1, 2023; Ord. 2735 § 2 (part), 1983).

9.50.140 Other parked vehicles.

It is unlawful for the operator of a vehicle to stop, stand or park such vehicle less than three feet from the front or rear of any lawfully parked vehicle or less than one foot from any vehicle lawfully parked at an angle, except when necessary to avoid conflict with other traffic or to comply with other provisions of this code, or with the directions of a police officer or traffic-control sign or device; provided, that provisions of this section shall not apply to those parking spaces designated as bumper-to-bumper parking. PERMIT PARKING

9.50.200 Residential parking permits in the central business district.

A. Authority. Residential parking permits for the central business district may be issued by the Yakima city director of finance and budget or her/his designee. Such permits shall apply to the area bounded by the center line of 6th Street on the east; the center line of Spruce Street on the south; the west curb line of 6th Avenue on the west; and the north curb line of Lincoln Avenue on the north less the area described as the core business district in YMC 9.10.030.

The Yakima city director of finance and budget or her/his designee has the authority to define a designated parking area for an issued residential parking permit.

B. Written Application. Permits may be issued by the director of finance and budget or her/his designee to a resident of the area described in subsection A of this section upon application of such resident to the director of finance and budget or her/his designee. Such application shall contain the following information:

(1) Name, address, and telephone number of the applicant together with proof of residency at such address, such as a copy of applicant’s lease, utility bill, or other documentation accepted at the discretion of the Yakima city director of finance and budget or her/his designee;

(2) Make, model, and year of applicant’s passenger motor vehicle or pickup truck, which shall not exceed eight thousand pounds in gross weight, which is registered to the applicant and for which a permit is sought;

(3) The names of those persons living in the same residential unit as the applicant;

(4) A representation that the applicant has a valid driver’s license, and that the applicant’s vehicle is registered, insured in accordance with state law, and operable and may be legally driven on the public highways of Washington State; and

(5) Such other information as the director of finance and budget or her/his designee may deem necessary in complying with the terms of this section.

C. Issuance. Upon proper application, the director of finance and budget or her/his designee may issue a residential parking permit to the applicant upon payment of a nonrefundable fee as set forth in the city of Yakima master fee schedule adopted via resolution by city council to cover the cost of administration. Such permit shall expire a year after its issuance and may be renewed annually. The permit shall be in the form of a vehicle windshield sticker issued by the director of finance and budget or her/his designee, containing the make, model, year, and license number of the vehicle to which such permit applies.

D. Rules and Regulations.

(1) No more than two residential parking permits may be issued per residential unit within the area described in subsection A of this section. A “residential unit” means a housing unit in which all persons reside as a single group, such as a family, whether in a single or multiple dwelling.

(2) The permit granted under this section shall apply only to the area designated in subsection A of this section. Such permit does not reserve a parking space in such area upon the public streets.

(3) In order for such permit to be valid, it must be displayed on the left rear window of the vehicle to which it applies.

(4) Such permit shall not be transferable; provided, that a permit which has more than six months remaining may be reissued by the director of finance and budget or her/his designee for its unexpired term to the original applicant upon applicant’s showing that the vehicle to which such permit applies has been sold, destroyed, or otherwise transferred or that the applicant has moved to another residential unit within the area described in subsection A of this section and for which no permit is issued.

(5) The permit granted under this section shall not apply to areas where parking is not otherwise allowed and the following restrictive parking zones: fifteen-minute, thirty-minute, loading zone, and handicapped zone. In addition, such permit applies only to parking within a quarter of a mile from the applicant’s residence listed on the permit.

(6) It is unlawful to: (a) affix a permit issued under this section on a vehicle other than that to which it applies; (b) knowingly provide false information in obtaining such permit.

(7) Permits shall not be issued to persons with outstanding/unpaid parking violations and/or traffic infractions.

(8) The director of finance and budget is authorized to adopt such further rules and regulations, not inconsistent with rules and regulations of this subsection, as the director deems necessary or advisable to administer the permit system authorized and adopted by this section. 9.50.210 Special parking permit—Fees—Regulations.

A. Effective January 1, 1977, a special parking permit may be obtained by filing a written application therefor with the customer services manager of the city of Yakima, which application shall state the name and address of the applicant, a statement as to the business in which applicant is engaged, and a description of applicant’s trucks or automobiles used in the conduct and operation of applicant’s business. Special parking permits are to be issued and used only for vehicles used in building maintenance, building construction, or equipment service or installation.

B. It is the duty of the customer services manager to investigate the facts stated in the application and determine the necessity for the use of the special parking permit in conducting or operating the business of the applicant.

C. Upon the approval of the application by the customer services manager, the approved application shall be presented by the applicant to the director of finance and budget, and applicant shall pay the director one month’s permit fee as set forth in the city of Yakima master fee schedule adopted via resolution by city council.

D. The fee for a special parking permit is set forth in the city of Yakima master fee schedule adopted via resolution by city council, with all fees being payable in advance.

E. It is unlawful for any person, firm or corporation to use a special parking permit in violation of the rules and regulations set out in the approved application.

F. It is unlawful for any person, firm or corporation to use a special parking permit in any fifteen-minute or thirty-minute parking meter zone.

G. It is unlawful to use a special parking permit unless the parking space is occupied by a motor vehicle described in the application for such permit. (Ord. 2023-036 § 1, 2023; Ord. 2022-040 § 59, 2022; Ord. 2735 § 2 (part), 1983).

9.50.215 City-owned parking lots—Parking regulated.

A. “City-owned parking lot” means each of the following city-owned public parking lots:

Lot 1: East “A” Street parking lot—Lots 23 through 32, Block 50, of the town of North Yakima (now city of Yakima). This parking lot is bounded on the west by North 2nd Street, and on the north by East “A” Street.

Lot 2: South 3rd Street parking lot—Lots 13 through 32, Block 51, of the town of North Yakima (now city of Yakima). This parking lot is bounded on the east by South 3rd Street, on the south by East Chestnut Avenue, and on the west by South 2nd Street.

Lot 4: North 1st Street and East “A” Street parking lot—Lots 23 through 27, Block 50, of the town of North Yakima (now city of Yakima). This parking lot is bounded on the north by East “A” Street and on the west by North 1st Street.

Lot 5: North 1st Street parking lot—Lots 13 through 19, Block 10, of the town of North Yakima (now city of Yakima). This parking lot is bounded on the east by North 1st Street.

Lot 6: South 2nd Street parking lot—Lots 8 and 9, Block 32. This parking lot is located at 112 South 2nd Street.

C. The procedures for enforcing the parking prohibitions of this section shall be those procedures provided by Chapter 9.60 of the city code as applicable to parking violations; provided, that the chief of police or his agent is authorized to immediately impound or cause to be impounded any unauthorized vehicle parked in city-owned public parking lots described in subsection A of this section. The applicable provisions of Chapter 9.47 of the city code shall govern towing, storage, redemption, or other disposition of any vehicle impounded pursuant to this section. 9.50.220 Long-term parking permits.

A. Issuance of Permits. The issuance of permits to authorize long-term vehicular parking in parking lots owned by the city shall be administered by the city department of finance and budget according to the following rules and regulations:

1. Number—Existing Permits—Waiting List. The number of long-term permits to be issued for parking in any lot shall not exceed sixty percent of the parking spaces in each respective lot. The provisions of this section shall be administered by the city department of finance and budget. Issuance of new long-term parking permits shall be issued on a first-come, first-served basis. When the quota is filled for any one parking lot, the applicant will be given the opportunity to be issued a long-term parking permit for any available parking space in another city-owned parking lot. When quotas are filled, subsequent applications for long-term parking permits received after the quota is filled will be placed on file in the order received, a waiting list will be established, and permits will be issued as openings occur.

2. Eligibility—Location. Permits shall be issued only upon the written application of a resident residing within, or an owner, manager or employee of a business or governmental agency located within the area bounded by the following streets:

East Martin Luther King, Jr. Boulevard on the north; Naches Avenue on the east; Walnut Street on the south; and First Street on the west.

3. Residential Permits. No more than two long-term parking permits may be issued to the resident of each residential unit within the area described in subsection (A)(2) of this section. A “residential unit” means a housing unit in which all persons reside as a single group, such as a family, whether in a single or multiple dwelling.

4. Application—Form. Application shall be made on forms furnished by the office of the director of finance and budget. Said application forms shall require, at a minimum, the following information and documentation:

a. Name, address, and telephone number of the applicant;

b. Make, model, and year of the passenger motor vehicle or pickup truck, which vehicle shall not exceed fourteen thousand pounds in gross weight, which is registered to the applicant and for which the permit is sought;

c. In the case of a resident applying for a permit, the names of those persons living in the same residential unit as the applicant;

d. A copy of the current vehicle registration;

e. A copy of the applicant’s current driver’s license;

f. A copy of the applicant’s current proof of insurance in the form required by RCW 46.30.030;

g. A representation that the vehicle is operable and may be legally driven on the public highways of Washington State; and

h. Such other information as the director of finance and budget or her/his designee may deem necessary in complying with the terms of this section.

5. Issuance of Permit—No Designation of Parking Space. The director of finance and budget or her/his designee has discretion to designate permitted parking by zone, assigned by stall number, or other method that clearly shows the location of permit parking. If designated by any method other than assigned stall number, the issuance of a permit does not reserve a designated parking space in the parking lot and each applicant for a permit shall acknowledge in writing that no such space is reserved and that the issuance of a permit by the city does not guarantee the availability of a parking space at all times.

6. Permit—Designated Parking Lot. Each permit shall have designated thereon the parking lot for which the permit is valid, and the attempted use of a permit for parking in a lot other than designated on the permit shall not afford the parking privileges which otherwise may be enjoyed by the permit holder.

7. Term of Permit. Annual permits will be issued on an annual calendar basis, to expire on the last day of the month of December of each year. Quarterly or semi-annual permits may also be issued, with the calendar quarters consisting of: (a) January 1st through March 31st; (b) April 1st through June 30th; (c) July 1st through September 30th; and (d) October 1st through December 31st.

8. Fee. The fee for a long-term parking permit shall be set forth in the city of Yakima master fee schedule as adopted via resolution by city council, to be paid to the city at the time a new permit is issued, or at the time of making application for a renewal. The fee for a new permit to expire in less than one calendar year will be prorated at the rate set forth in the city of Yakima master fee schedule as adopted via resolution by city council for any full or partial calendar month remaining in the calendar year. No fee will be prorated for less than one full calendar month. Fees paid electronically by credit card or other means will be assessed a processing fee per transaction as set forth in the city of Yakima master fee schedule adopted via resolution by city council or such other amount as incurred by the city.

9. Renewal of Permits.

A. Annual Permits. Permits previously issued may be renewed for the next succeeding year, upon submission of an updated application and payment of the renewal fee between December 15th and December 25th of the year of expiration; applications for renewals will not be accepted prior to December 1st of the year of expiration.

B. Quarterly or Semi-Annual Permits. Previously issued quarterly and semi-annual permits may be renewed for the next succeeding quarter or other term upon submission of an updated application and payment of the renewal fee between the fifteenth day of the month of expiration through the twenty-fifth day of the month of expiration; applications for renewal shall not be accepted prior to the first day of the month of expiration.

10. Applications by Mail. Applications by mail for renewal will not be accepted unless applicant has made prior arrangement therefor with the office of the director of finance and budget.

11. Failure to Renew. Failure of a permit holder to apply for renewal within the renewal period specified by these rules may result in the loss of that permit to the next applicant therefor on the waiting list.

12. Cancellation by Permit Holder. Permits will be cancelled on the application by the permit holder for such cancellation, and the unused permit fee will be refunded as prorated at the rate set forth in the city of Yakima master fee schedule adopted by city council via resolution per month for each full calendar month remaining in the period for which the permit was issued. No refund of the permit fee will be made for a partial calendar month.

13. Permits Restricted. Permits shall not be issued to persons with outstanding city of Yakima parking violations.

14. Rules and Regulations. The director of finance and budget or her/his designee is authorized to adopt such further rules and regulations, not inconsistent with rules and regulations of this section, as the director deems necessary or advisable to administer the permit system authorized and adopted by this section. Such further rules and regulations may include supplemental terms, conditions and timelines, for issuance and renewals of long-term parking permits on a quarterly and/or semi-annual calendar basis.

15. Parking Violation. It is a violation of this chapter to park in designated long-term parking without a valid permit.

B. A vehicle displaying a valid parking permit issued pursuant to this section may remain parked in the parking lot area designated for permit parking specified on the permit for a period of time not to exceed twenty-four consecutive hours; provided, however, that said time restriction shall not apply to long-term parking permits issued to residents under this section. The permit must be displayed within the parked vehicle in such a manner as to be plainly visible and legible from a point outside the vehicle near the driver’s position. 9.50.230 City Hall parking lot—Parking regulated—Parking permit—Enforcement.

A. The parking lots owned by the city consisting of Lots 4 and 5, Block 48, and Lots 13, 14, 15 and 16, Block 49, of the town of North Yakima (now Yakima), Washington, according to the plat thereof recorded in Volume A of Plats, page 10, and rerecorded in Volume E, page 1, records of Yakima County, Washington, are designated as the City Hall parking lot.

B. Signs shall be conspicuously posted warning against parking of unauthorized vehicles at the City Hall parking lots designated in subsection A of this section, which sign shall also warn that unauthorized parked vehicles are subject to impoundment, and when such signs are so posted, it is unlawful for any person to park a vehicle in that City Hall parking lot unless the parking vehicle is a marked city-owned vehicle, or unless there is displayed within the parked vehicle a valid parking permit issued pursuant to subsection C of this section, so as to be plainly visible and legible from a point outside the vehicle near the driver’s position.

C. The issuing of parking permits referred to in subsection B of this section shall be administered by the customer services manager of the city. The permits shall be issued to such members of the management group of the city as designated by a policy or rules and regulations, as adopted or amended from time to time, of the customer services manager, subject to approval by the city manager.

D. The procedures for enforcing the parking prohibitions of this section shall be those procedures provided by Chapter 9.60 of the city code as applicable to parking violations; provided, that the chief of police or his agent is authorized to immediately impound or cause to be impounded any unauthorized vehicle parked in City Hall parking lots described in subsection A of this section. The applicable provisions of Chapter 9.47 of the city code shall govern towing, storage, redemption, or other disposition of any vehicle impounded pursuant to this section. 9.50.238 City parks parking lots—Parking regulated—Parking permits—Enforcement.

A. The city owns parking lots in or adjacent to the following city parks: Chesterly Park, Elks Park, Fisher Golf Course, Franklin Park, Gailleon Park and Harman Center, Gardner Park, Gilbert Park, Emil Kissel Park, Kiwanis Park, Lions Park, Miller Park, Milroy Park, Randall Park, and the Southeast Community Park.

B. Signs shall be conspicuously posted warning against parking of unauthorized vehicles at the city parks public parking lots designated in subsection A of this section, which sign shall also warn that unauthorized parked vehicles are subject to impoundment. When such signs are so posted, it is unlawful for any person to park an unauthorized vehicle in the city park parking lot unless the parking vehicle is a marked city-owned vehicle, or unless there is displayed within the parked vehicle a valid parking permit issued pursuant to subsection C of this section, so as to be plainly visible and legible from a point outside the vehicle near the driver’s position. Unauthorized vehicles shall include vehicles parked for a purpose other than patronizing the city park and vehicles parked during the hours of park closure.

C. The issuing of parking permits referred to in subsection B of this section shall be administered by the parks department manager of the city. The permits shall be issued as designated by a policy or rules and regulations, as adopted or amended from time to time, of the parks department manager, subject to approval by the city manager.

D. The procedures for enforcing the parking prohibitions of this section shall be those procedures provided by Chapter 9.60 of the city code as applicable to parking violations; provided, that the chief of police or his agent is authorized to immediately impound or cause to be impounded any unauthorized vehicle parked in city parks parking lots described in subsection A of this section. The applicable provisions of Chapter 9.47 of the city code shall govern towing, storage, redemption, or other disposition of any vehicle impounded pursuant to this section. MISCELLANEOUS RULES

9.50.240 Establishment of fire zone—Duties of public.

A. There is established about the scene of every fire during its course a “fire zone” which shall consist of all public streets within a radius of three hundred feet or more from the fire, and in every case shall include the two nearest street intersections.

The “fire zone” shall remain in existence until such time as the chief of the fire department or his authorized agent shall declare the emergency past.

Commanding officers at fires shall have authority to remove from the “fire zone” obstructions to the extinguishing of fires.

All traffic, including locomotives, railroad cars, vehicular and pedestrian, within a “fire zone” shall stop in a safe place, and it is unlawful for any person to move, operate or start to move or operate any vehicle except upon orders of the chief of police or the chief of the fire department or their authorized agents.

It is unlawful to enter a “fire zone” or to stop, stand or park in such a manner as to hinder the apparatus of the fire department in entering or leaving any “fire zone.”

B. It is unlawful for the chief of the fire department and his authorized agents to require the aid of the operator of any vehicle, in drawing or conveying any apparatus, equipment or tools of the fire department to a fire.

C. During an emergency requiring the services of the fire department, the chief or his authorized agent is authorized to establish firelines on a public street or private property, by roping off same, or by stationing a fireman in uniform, or a police officer, to direct traffic, and it is unlawful for any person to disregard or fail to obey the orders of the fireman or police officer or to run over the rope or to operate any vehicle inside firelines.

D. The chief of the fire department or his authorized agent may, when the walls of a burned building are unsafe or in such condition as to endanger traffic on public streets, or when any pole, chimney, spire, steeple, electric wire or other thing or object endangers human life or property in the public streets, rope, fence or wall-off parts of public streets and private property in and adjacent thereto and place suitable signs marked “danger” about same, or caution lights at night, and it is unlawful for any person to remove, mutilate, tear down or otherwise damage any sign, fence, wall or rope, or to walk, or to drive, operate or move any vehicle inside the lines, fences, or walls. (Ord. 2023-036 § 1, 2023; Ord. 2735 § 2 (part), 1983).

9.50.260 Unnecessary noise.

(a) It is unlawful to operate any vehicle in such a manner as to cause any unnecessary or unreasonably loud noise, whether due to sudden starting, sudden stopping, exhaust explosion, lack of proper muffler, or by any other means.

(b) It is unlawful for any vehicle, other than any vehicle of any municipal fire department, to use compression braking, also known as engine braking or “jake brakes,” at any time. It shall be an affirmative defense to a violation of subsection (b) of this section that said compression braking occurred during a bona fide emergency.

(c) Posting of Notice. The city of Yakima public works department shall post at reasonable locations within the city of Yakima signs indicated “Unmuffled Compression Brakes Prohibited” or substantially similar wording.

(d) Penalty. Violation of amended YMC 9.50.260(b) shall be punishable as a traffic infraction under the same terms and conditions described in YMC 9.60.030. (Ord. 2023-036 § 1, 2023; Ord. 2005-40 §§ 1—3, 2005: Ord. 2735 § 2 (part), 1983).

9.50.280 Avoidance of intersections—Penalty.

A. It is unlawful for any person operating a motor vehicle on the roads within the city of Yakima to turn such vehicle either to the right or to the left upon approaching or leaving intersections and to proceed across any private property for the purpose of avoiding the intersection or any traffic control device controlling the intersection, unless so directed by lawful authority.

B. A violation of this section shall be a traffic infraction punishable by a monetary penalty of one hundred twenty-four dollars. (Ord. 2023-036 § 1, 2023; Ord. 2009-35 § 1, 2009).

9.50.290 One-way streets and alleys.

Upon those streets and parts of streets and in those alleys herein described, vehicular traffic shall move only in the indicated direction when signs indicating the direction of traffic are erected and maintained at every intersection where movement in the opposite direction is prohibited. No such regulation shall be effective unless such signs are in place.

RIGHT-OF-WAY

9.50.300 State highways designated as arterial highways.

All state highways are declared to be arterial highways as respects all other public highways or private ways except those city streets that the Washington State Highway Commission has designated as an arterial having preference over the traffic on the state highway.

Those city streets designated by the Washington State Transportation Commission as forming a part of the routes of state highways through the city are declared to be arterial highways as respects all other city streets or private ways. (Ord. 2023-036 § 1, 2023; Ord. 2735 § 2 (part), 1983).

9.50.310 Arterial highways.

The following streets and portions of streets are designated arterial highways for the purpose of this title:

1. 1st Street from north city limits to south city limits;

2. 3rd Street from “I” Street to South 1st Street;

3. 6th Street from Lincoln Avenue to Nob Hill Boulevard;

4. 8th Street from “G” Street to Yakima Avenue;

5. Fair Avenue from Spruce Street to 10th Street;

6. 10th Street from Fair Avenue to Mead Avenue;

7. 3rd Avenue from “D” Street to south city limits;

8. 5th Avenue from “I” Street to Division Street;

9. 6th Avenue from north city limits to Fruitvale Boulevard;

PEDESTRIANS’ RIGHTS AND DUTIES

9.50.320 Pedestrians’ duties.

Pedestrians shall not step into that portion of the street open to moving traffic at any point between intersections in the central business district, in any business district, on any arterial highway, or between adjacent intersections of streets protected by traffic signal devices or stop signs, except as marked crosswalks or other places specially provided. (Ord. 2023-036 § 1, 2023; Ord. 2735 § 2 (part), 1983).

9.50.330 Pedestrian duties at railroad crossings.

Whenever any pedestrian approaches a railroad grade crossing or a street or interurban railroad grade crossing under any of the circumstances herein stated, such pedestrian shall stop and not pass such crossing but shall remain at a safe place until such circumstances shall have ceased.

The foregoing requirements shall apply when:

1. A clearly visible electric or mechanical signal device gives warning of the immediate approach of a train proceeding through the crossing; or

2. A crossing gate or barrier is lowered or being lowered or raised or when a human flagman gives or continues to give a signal of the approach or passage of a train; or

3. An approaching train is plainly visible and is in hazardous proximity to such crossing; or

4. An approaching train emits a signal which is audible at such grade crossing and such train by reason of its speed or nearness to such crossing is an immediate hazard. (Ord. 2023-036 § 1, 2023; Ord. 2735 § 2 (part), 1983).

“U” TURNS AND TURNS ACROSS TRAFFIC

9.50.340 “U” turns.

No operator of a vehicle shall make a “U” turn in a business district; provided, that “U” turns are permitted in designated “U” turn lanes within a pedestrian mall as defined by YMC 9.10.050. No operator of a vehicle shall make a “U” turn at a point in the city outside a business district or a pedestrian mall except at a street intersection or a street end. 9.50.350 Turning vehicle across opposing traffic to park.

No person shall turn a vehicle across opposing traffic lanes for the purpose of parallel or angle parking. (Ord. 2023-036 § 1, 2023; Ord. 2735 § 2 (part), 1983).

SPEED REGULATIONS

9.50.360 Speed regulations.

A. It is determined upon the basis of an engineering and traffic investigation that the speed permitted by state law on the highways described in YMC 9.50.370, all in the city of Yakima, varies from that which is deemed reasonable or safe under the conditions found to exist upon such highways and it is declared that the speed limits shall be as hereinafter set forth in YMC 9.50.370 on those highways designated therein at the time specified therein when signs are erected giving notice thereof. No person shall operate a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions, and having regard to the actual and potential hazards then existing, or in any event, greater than that speed limit set forth in YMC 9.50.370, except as allowed for by law. 9.50.370 Speed limits.

In accordance with YMC 9.50.360, and when properly signposted, speed limits during the time specified over and along the streets designated are:

A. Fifteen miles per hour:

1. On all city alleys at all times not otherwise designated or officially signposted;

B. Twenty miles per hour on all unpaved streets and the following streets:

1. 6th Avenue from Spruce Street to Division Street,

2. Cornell Avenue from Division Street to Nob Hill Boulevard,

3. 12th Avenue from Arlington Street to Nob Hill Boulevard,

4. 15th Avenue from Nob Hill Boulevard to Prasch Avenue,

5. 37th Avenue from Richey Road to Summitview Avenue,

6. 37th Avenue from Summitview Avenue to Tieton Drive,

7. 38th Avenue from Tieton Drive to Nob Hill Boulevard,

9.50.375 Reduced speed limits on city streets and roadways during sealant coating application.

During periods when city streets and roadways are being sealant coated, speed limits on treated portions of the streets and roadways shall be temporarily re-posted to a speed limit of twenty miles per hour. Re-posting of the speed limit shall be performed in a manner conforming to YMC 9.46.020, RCW 47.36.060 and all other applicable state and federal requirements. The twenty-mile-per-hour speed limit shall become effective when the temporary speed limit signs are posted on the streets and roadways and shall continue in effect until city personnel remove the temporary signs, following the appropriate sealant application and curing period.

The temporary twenty-mile-per-hour speed limit shall be fully enforceable by law enforcement officers authorized to enforce traffic safety laws within the city of Yakima. A violation of this section shall be chargeable as an infraction punishable as a violation of posted speed restrictions in accord with RCW 46.61.400. 9.50.380 Maximum speed limit when passing school or playground crosswalks.

Subject to RCW 46.61.400(1), and except in those instances where a lower maximum lawful speed is provided by this chapter or otherwise, it is unlawful for the operator of any vehicle to operate the same at a speed in excess of twenty miles per hour when operating any vehicle upon a highway when passing any marked school or playground crosswalk when such marked crosswalk is fully posted with standard school or playground speed limit signs. The speed zone at the crosswalk shall extend three hundred feet in either direction from the marked crosswalk. (Ord. 2023-036 § 1, 2023; Ord. 2735 § 2 (part), 1983).

INATTENTION

9.50.390 Inattention.

It is a traffic infraction for any person to drive a vehicle within the city in an inattentive manner. For the purpose of this section, “inattentive manner” means to drive in such a manner so as to fail to maintain a careful lookout in the direction of travel or to otherwise drive without due vigilance for persons or property in or near the path of such vehicle. MOTORIZED FOOT SCOOTERS

9.50.810 Definitions.

The following words and phrases, when used in this chapter, shall for purposes of this chapter have the meanings respectively ascribed to them in this section:

“Helmet” means a head covering that meets or exceeds safety standards adopted by Standard Z-90.4 set by the American National Standards Institute (ANSI), or the Snell Foundation, or such subsequent nationally recognized standard for bicycle helmet performance as the city council may adopt.

“Modified or enhanced” means to alter the settings, displacement/horsepower or muffler effect to achieve greater power and/or performance than provided when the unit was delivered from the factory for sale.

“Motorized foot scooter” means a device with no more than two twelve-inch or smaller diameter wheels that has handlebars, is designed to be stood or sat upon by the operator, and is powered by an internal combustion engine or electric motor that is capable of propelling the device with or without human propulsion.

“Operate in a negligent manner” means the operation of the device described in this section in such a manner as to endanger or be likely to endanger any person or property. Examples of operating in a negligent manner include, but are not limited to, failure to obey all traffic-control devices, and failure to yield right-of-way to pedestrians and/or vehicular traffic. 9.50.820 Duty to obey traffic-control devices and rules of the road.

Any person operating a motorized foot scooter shall obey all rules of the road applicable to vehicle or pedestrian traffic, as well as the instructions of official traffic-control signals, signs and other control devices applicable to vehicles, unless otherwise directed by a police officer. Every person operating a motorized foot scooter upon a public way shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a vehicle pursuant to RCW 46.61 except as to those provisions thereof which by their nature can have no application. 9.50.830 Unsafe use prohibited.

No motorized foot scooter shall be ridden in a negligent or unsafe manner but shall be operated with reasonable regard for the safety of the operator and other persons. (Ord. 2023-036 § 1, 2023; Ord. 2004-70 § 4, 2004; Ord. 2004-39 § 1 (part), 2004. Formerly 9.50.430).

9.50.840 Prohibited areas.

A. Central Business District. It is unlawful for any person to operate or ride upon a motorized foot scooter or similar device upon any street, alley, sidewalk, park or publicly owned parking lot in the central business district of the city of Yakima as described in YMC 9.10.010.

B. Parks, Sidewalks and Streets. Pursuant to YMC 13.16.090, motorized foot scooters are prohibited from city parks and other identified “nonmotorized corridors” and violations of the restrictions stated in YMC 13.16.090 are subject to the specific penalties set forth therein. Motorized foot scooters are also prohibited from being operated on sidewalks within the city limits or on any street with a posted speed limit greater than twenty-five miles per hour. 9.50.850 Requirements for operating motorized foot scooters.

A. Minimum Age. No motorized foot scooter shall be operated on streets or other public areas not otherwise prohibited to motorized foot scooters by this chapter unless the operator has a valid driver’s license.

(1) Failure of a motorized foot scooter operator to have a valid driver’s license on their person while operating a motorized foot scooter in the city of Yakima is a traffic infraction.

(2) Only one person may occupy a motorized foot scooter at one time. No motorized foot scooter operator may transport passengers or tow other devices or persons behind a motorized foot scooter.

B. Helmet, Light and Reflectors. The following equipment shall be required whenever a motorized foot scooter is operated on streets or other public property within the city.

(1) Helmet Required. Any person operating a motorized foot scooter upon any public area in the city shall wear an approved helmet designed for safety and meeting or exceeding the standards set forth in YMC 9.50.810. The operator shall have the helmet’s neck or chin strap fastened securely while the motorized foot scooter is in motion. A parent or guardian is responsible for requiring that a child under the age of eighteen years wears an approved helmet while said child is operating a motorized foot scooter in the city, and that the child’s helmet neck or chin strap is securely fastened.

(2) Light and Reflectors Required. Pursuant to RCW 46.61.780, a motorized foot scooter operated during the hours of darkness as defined in RCW 46.37.020 shall, as a minimum requirement, be equipped with a lamp on the front which shall emit a white light visible from a distance of at least five hundred feet to the front and with a red reflector on the rear of a type approved by the Washington State Patrol which shall be visible from all distances up to six hundred feet to the rear when directly in front of lawful lower beams of head lamps on a motor vehicle.

(3) Brake Required. Every motorized foot scooter shall be equipped with a brake which, when applied, will enable the operator to make the braked wheel(s) skid on dry, level, clean pavement.

(4) Muffler Required. Every motorized foot scooter powered by an internal combustion engine shall have a properly functioning engine muffler attached and constantly operational during use of the motorized foot scooter to prevent excessive and/or unreasonable noise as defined in YMC 6.04.180(D)(2) and (E).

(5) Motorized foot scooters operated within the city of Yakima shall not be modified or enhanced in design or construction from the specifications provided by the manufacturer. (Ord. 2023-036 § 1, 2023; Ord. 2004-70 § 6, 2004; Ord. 2004-39 § 1 (part), 2004. Formerly 9.50.450).

9.50.860 Dealer notice required.

All persons and/or establishments within the city of Yakima that are involved in the retail sales of motorized foot scooters shall provide each purchaser of said motorized foot scooter with a written advisement of the regulations, restrictions and requirements of YMC 9.50.810 through 9.50.880 prior to completing the sale of said motorized foot scooter. 9.50.870 Violation—Penalty.

Any person violating any provision of this article, except for the specific provisions of YMC 13.16.090, shall be guilty of a traffic infraction and shall be punished by the imposition of a monetary penalty of not more than two hundred fifty dollars, exclusive of statutory assessments; provided, that conduct that constitutes a criminal traffic offense may be charged as such and is subject to the maximum penalties allowed for such offenses. 9.50.880 Severability.

Each separate provision of YMC 9.50.810 through 9.50.880 shall be deemed independent of all other provisions. If any provision of these sections, or any part thereof, be declared invalid, all other provisions, or parts thereof, shall remain valid and enforceable.
