17.56.010 Purpose.

The local business-restricted district is intended to supplement the low intensity neighborhood commercial objectives of the B-1 local business district in neighborhoods: where small, shallow or narrow lots are present that would require the granting of a variance or special exception in order to create a building pad; where commercial parcels are adjacent to residential development located on small, narrow or shallow lots or which have offsets below those required by code; where the pattern of land division has resulted in fragmented parcels under the ownership of individuals with unrelated interest; or where the mass and form of adjacent residential and commercial buildings is diminutive. The supplemental regulations of this district address building size and height, floor area ratio and architecture. (Ord. 1589 § 1(1), 1997: prior code § 17.345 (part))

17.56.020 Use regulations.

A.    Permitted Uses. Subject to all approvals and conditions required by Chapter 17.100 and the provisions of this district, the permitted uses shall be any use permitted in the B-1 local business district, except those uses prohibited by subsection (B) of this section.

B.    Prohibited Uses. Intensive uses as defined in Chapter 17.108.

C.    Accessory structures with foundations in association with the creation of “third places” within the building setback include pergolas, permanent seating, band shells, decks, gazebos or similar structure as determined by the plan commission. 17.56.030 Building and parking locations.

Building and parking locations shall be the same as those in the B-1 local business district except that the building setback averaging provisions of Chapter 17.112 shall apply. However, in no case shall the minimum building setback be reduced to less than fifty (50) feet. (Ord. 1589 § 1(3), 1997: prior code § 17.345 (part))

17.56.040 Offsets.

Offsets shall be the same as those in Section 17.52.020(B) of the B-1 local business district. (Ord. 1589 § 1(4), 1997: prior code § 17.345 (part))

17.56.050 Height regulations.

A.    Principal building height shall not exceed twenty-four (24) feet. Second floor occupancy shall be permitted only in one and one-half story buildings.

B.    Accessory building height shall not exceed fifteen (15) feet. (Ord. 1589 § 1(5), 1997: prior code § 17.345 (part))

17.56.060 Area regulations.

A.    Floor Area.

1.    The minimum required for residence purposes shall be the same as that in the M-1 multiple-family district. A residential unit in a building used in part for commercial purposes shall meet the requirements for multiple-family dwellings.

2.    The maximum FAR permitted is twenty (20) percent, including accessory buildings.

3.    The maximum floor area of a building shall not exceed five thousand (5,000) square feet.

B.    Lot area shall be the same as Section 17.52.040(B) of the B-1 local business district.

C.    Open space shall be the same as Section 17.52.040(C) of the B-1 local business district.

D.    Lot coverage and landscape surface ratio shall be the same as Section 17.52.040(D) of the B-1 local business district. (Ord. 1589 § 1(6), 1997: prior code § 17.345 (part))
