4.40.010 Runoff election – Required.

a. A runoff election shall be held to fill an office that is not filled under HCC 4.35.020 or HCC 4.35.030 at the initial election for the office.

b. The two candidates for the office that received the highest number of votes without being elected at the initial election shall be the candidates for an office that is to be filled by a runoff election.

c. If a runoff election for Council is required, any candidate who was elected to the Council at the regular election shall:

1. Retain the same seat if reelected;

2. If there is one Council member whose term is expiring and who was not a candidate for reelection, succeed that Council member; or

3. If neither subsection (c)(1) nor (c)(2) of this section applies, take office after certification of the runoff election. [Ord. 16-01(A)(S) § 7, 2016; Ord. 95-1(S), 1995; Ord. 91-1 § 1, 1991; Ord. 88-14 § 3, 1988; Ord. 82-6 § 20, 1982].

4.40.020 Runoff election – Date and notice.

a. If a runoff election is required due to the outcome of a regular election, the runoff election shall be held on the Tuesday after the first Monday in November. If a runoff election is required due to the outcome of a special election, the runoff election shall be held on the fourth Tuesday following the special election.

b. At least five days prior to the election, the City Clerk shall post notice of a runoff election in three public places and publish it once in a newspaper of general circulation in the City. The notice shall be in substantially the same form as the notice required for regular and special elections set forth at HCC 4.01.050. [Ord. 95-1(S), 1995; Ord. 91-1 § 2, 1991].
