11.35.010 Disposal of surplus personal property.

(a)    Supplies, materials, equipment or other personal property, estimated by the manager to be in excess of two thousand five hundred dollars ($2,500), which are obsolete or no longer required for borough purposes may be disposed of as surplus property in the manner provided by resolution of the assembly declaring such property as surplus and prescribing the method of disposal.

(b)    Unless otherwise provided by this code or by law, the borough manager is authorized to dispose of surplus personal property of the borough with a value of two thousand five hundred dollars ($2,500) or less in the manner specifically set forth in subsection (c) of this section.

(c)    Methods of disposal may include, but are not limited to:

(1)    Exchange the same for, or apply the same against, new supplies, materials, equipment or other property.

(2)    On the open market by telephone solicitation, written quotation or competitive bid.

(3)    Exchange, donation or transfer to another governmental unit, or to a charitable, civic or nonprofit organization.

(4)    By public auction. The manager shall promulgate rules for the conduct of the auction. No auction shall be without reserve unless prior to the auction it is announced to be without reserve.
