5.20.040 Aerials.

No person shall erect or maintain any aerial in such position, over, above or higher than any high-tension electrical wire, without first having applied for and received a permit signed by two members of the appointed board of electrical inspectors. (Ord. O-93-6-6 § 1 (part), 1994)

5.20.050 Sales of electricity.

No person shall sell or purchase electricity within the city from or to any person other than from or to the city municipal utilities system. (Ord. O-93-6-6 § 1 (part), 1994)

5.20.060 Alternate energy facilities.

(a) Whenever a person proposes to construct a structure or modify an existing structure in order to operate a small-scale alternate energy facility, he shall obtain a preliminary building permit before submitting preliminary plans and specifications to the utilities manager as required under Section 15.40.030(c). The preliminary building permit shall be obtained in compliance with the same procedures and requirements set forth in Section 5.10.030 for other building permits, except that no fee shall be imposed or collected by the city clerk until such time as a final building permit is issued.

(b) The final building permit shall be issued upon submission of written approval of the customer’s plans and specifications by the utilities manager under Section 15.40.030(c) and upon payment of appropriate fees, unless the proposed construction plan has been changed from that described in the original application for building permit. If such a change has occurred, the applicant shall submit an amended application and otherwise follow the procedures of Section 5.10.030(c) before a final permit may be issued.

(c) The applicant may not commence construction of the alternate energy facility until the final building permit is issued. Thereafter, the posting and inspection requirements of this Chapter shall apply in addition to any inspection requirements imposed by Section 15.30.030. (Ord. O-93-6-6 § 1 (part), 1994)

5.20.070 Violations—Penalties.

A person who violates any provision of this chapter is guilty of an infraction and upon conviction shall be fined in the amount set forth in NCO Section 1.20.040, or if no fine is there established an amount not to exceed three hundred dollars, plus any surcharge required to be imposed by AS 12.55.039. Each day an infraction occurs shall constitute a separate offense. (Ord. O-14-01-02 § 10, 2014)
