13.10.010 Fireworks prohibited.

(a) No person shall possess dangerous fireworks or salable fireworks within the city limits of the city. All such fireworks shall be confiscated and possession shall be considered an infraction punishable by a fine of up to two hundred dollars.

(b) No person shall sell or offer for sale within the city any dangerous fireworks, and no person shall sell or offer for sale within the city any salable fireworks without first obtaining a permit to do so from the Nome fire chief. Failure to obtain a permit prior to offering such fireworks for sale shall be an infraction punishable by a fine of up to five hundred dollars.

(c) No person shall explode or cause to be exploded within the city any dangerous fireworks and no person shall explode or cause to be exploded within the city any salable fireworks without first obtaining a permit to do so from the Nome fire chief. Failure to obtain a permit prior to exploding such fireworks shall be an infraction punishable by a fine of up to two hundred dollars.

(d) “Dangerous fireworks” and “salable fireworks” as used in this chapter are defined as they are defined in Alaska Statutes or as otherwise defined in the Fire Safety Code of the state adopted and administered by the Division of Fire Prevention of the Department of Public Safety.
