12.08.010 Use of motor vehicles on city-operated playgrounds, parks, cemetery reserves and historical sites prohibited. Revised 7/18

A. It is unlawful for any person to operate a motor vehicle on city-operated playgrounds, parks, cemetery reserves and historical sites except that it is lawful to operate a motor vehicle on city-operated playgrounds, parks, cemetery reserves and historical sites:

1. For the purpose of maintenance of said playgrounds, parks, cemetery reserves and historical sites;

2. For the purpose of crossing the lagoon from Utqiaġvik on to Browerville or the reserve in the winter months;

3. For the purpose of access to traditional routes to inland subsistence sites; and

4. In the use of cemetery reserve, for the purpose of maintaining gravesites or preparing gravesites for burial and for the conduct of burial services.

Provided, however, exceptions 2 and 3 in subsections (A)(2) and (3) of this section shall not apply to playgrounds, parks, cemetery or historical sites in use by children playing, for recreational activities; and/or funeral services.

B. Violation of this section shall constitute an infraction and shall be punishable by a maximum fine of three hundred dollars.

C. Motor vehicles used on city-operated playgrounds, parks, cemetery reserves and historical sites for special events may be allowed only after a permit is approved by the city council. (Ord. 02-2017 §2(part); Ord. 88-7 §3(part): Ord. 85-4 §3)

12.08.020 Taking of sod, gravel and sand from public property prohibited. Revised 7/18

A. It is unlawful for any person or organization to dig and/or take away from any public property, sod, gravel or sand without the express permission of the owner or lessee of the property.

B. For the purpose of this section “public property” shall be defined as property owned or leased by the city of Utqiaġvik, the North Slope Borough or the state of Alaska or any other property designated as municipal or cemetery reserve under the laws and ordinances of the city or the North Slope Borough.

C. Violation of this section shall constitute an infraction and shall be punishable by a maximum fine of three hundred dollars. (Ord. 02-2017 §2(part); Ord. 88-7 §3(part): Ord. 85-5 §3)

12.08.030 Use of Lot 16B for concession stands, booths, or tents – Single use of Lot 16B. Revised 7/18

A. It is unlawful for any person to operate a concession stand, booth, or tents without a permit for the use of public places, namely Lot 16B.

B. It is unlawful for any organization or business to have single use, such as corporate picnics, or other organizational summer activities without a permit for the use of public places, namely Lot 16B. The interested parties are encouraged to get a permit from City Hall.

C. For the purpose of this section “public property” shall be defined as property owned or leased by the city of Utqiaġvik, the North Slope Borough or the state of Alaska or any other property designated as municipal reserve under the laws and ordinances of the city or the North Slope Borough.

D. The mayor shall establish plots for areas to be used by the public for concession stands, booths or tents.

E. Permit – Concession Stand, Booth or Tent. City Hall shall make available forms for application of concession stand, booth or tent. The permit shall be set at a rate per day for one plot for each individual, business or organization by formal resolution of the Utqiaġvik city council.

F. Permit – Single-Use Permit of Lot 16B. City Hall shall make available forms for application for single-use permit for each business or organization. The permit shall be set at a rate for each whole day use permit by formal resolution of the Utqiaġvik city council. Single use is for any corporate picnics and other summer organizational activities.

G. Permit – Application. An applicant for concession stand, booth, or tents/single use of Lot 16B shall have the name of an individual, or a name of business or organization, address, phone number, fax number (if available), and e-mail (if available).

H. Permit – Issuance. The city clerk shall issue a concession permit/single use of Lot 16B to each individual, organization or business who complies to the requirements of subsections D and E of this section.

I. The permit is not refundable. No permit is transferable.

J. Exemptions. This will be determined by the mayor to make an exemption to any party applying for a permit. (Ord. 04-2017 §4; Ord. 02-2017 §2(part); Ord. 02-2014 §4; Ord. 2008-10 §2)
