5.12.010 Definitions.

In this chapter, “contractor” means “contractor” as defined in Alaska Statutes Section 08.18.171, and includes “general contractor,” “builder,” and “specialty contractor” as defined therein. (Prior code § 6A-5)

5.12.020 Registration required.

No person shall submit a bid or work as a contractor in the city until that person has been issued a certificate of registration by the state of Alaska, Department of Commerce and Economic Development pursuant to Alaska Statutes Chapter 08.18. A partnership or joint venture shall be considered registered if one of the general partners or venturers whose name appears in the name under which the partnership or venture does business is registered. 5.12.030 Contractors to comply with state law.

No person shall submit a bid or work as a contractor in the city in violation of any of the provisions of Alaska Statutes Chapter 08.18. (Prior code § 6A-2)

5.12.040 Duty to offer certificate of registration for examination.

Any person who shall submit a bid or work as a contractor and/or a person required to hold a certificate of fitness per Alaska Statute 18.62.010 or Alaska Administrative Code 13.50.035 in the city shall provide a current copy of the person’s certificate of registration or certificate of fitness to the city building official and any employer, contractor, prospective employer or prospective contractor of the person. 5.12.050 Exemptions.

Those persons exempted from Alaska Statutes Chapter 08.18 pursuant to Alaska Statute Section 08.18.161 are also exempt from Sections 5.12.020 through 5.12.040 of this chapter. (Prior code § 6A-4)

5.12.060 Violation—Penalty—Enforcement.

A.    Any violation of Sections 5.12.020 through 5.12.040 of this chapter is an offense punishable pursuant to Section 1.08.010 of this code.

B.    The city building official shall have the authority to enforce this chapter.

C.    If the building official determines that a contractor or a person acting in the capacity of a contractor, is in violation of this chapter, the building official or designee may give written notice to the person, prohibiting further action by the person as a contractor. The prohibition continues until the person has submitted evidence acceptable to the building official showing that the violation has been corrected. (Ord. 96-24 § 2: prior code § 6A-6)
