18.05.010 Title.

These regulations shall be known and cited as the “Huachuca City zoning regulations,” and shall be referred to herein as “these regulations.” (Ord. 06-10, 2006; prior code § 17-1-1)

18.05.020 Purpose.

The purpose of these regulations is to secure adequate light and air, to prevent the overcrowding of land and undue concentration of population, to secure land and undue concentration of population, to secure safety from fire, panic and other dangers, to lessen or avoid congestion in the streets, to facilitate the adequate provisions of transportation, water, sewerage, schools, parks, and other safety, morals, convenience and general welfare of the citizens of the town of Huachuca City, Arizona. 18.05.030 Intent.

It is the intent of these regulations not to interfere with, abrogate, or annul any easement, covenant, or other agreement between parties; provided, however, that where these regulations impose a greater restriction upon the use of buildings, structures or land, the provisions of these regulations shall prevail. 18.05.040 Severability clause.

Should a section or provision of these regulations be declared by the courts to be unconstitutional or invalid, such decision shall not affect the validity of these regulations as a whole, or any part thereof other than the part so declared to be unconstitutional or invalid. 18.05.050 Repeal of conflicting ordinances.

All ordinances or part of ordinances and all resolutions in conflict with these zoning regulations, or inconsistent with the provisions of these regulations, are hereby repealed. (Ord. 06-10, 2006; prior code § 17-32)
