5.18.010 Definitions.

A.    In this chapter, unless the context otherwise requires:

1.    "Yard Sale merchandise" means miscellaneous merchandise and personal property offered for sale at a yard sale.

2.    "Yard Sales" means the resale by an owner, resident or designee of a specific residence or lot of yard sale merchandise. Yard sales include, but are not limited to, "tag sales," "garage sales," "lawn sales," "carport sales," and any other similar activity conducted at premises used primarily for residential purposes.

5.18.020    Regulations.

1.    Yard sales shall only be conducted by the owner or resident of a residential address or lot and only for the purposes of selling yard sale merchandise, provided however, that neighborhood or combined yard sales shall be permitted where all other requirements of this section are followed.

2.    Yard sales shall be limited to no more than four (4) times per calendar year per residential address or lot and shall not exceed three (3) days in length for each of the four permitted times.

3.    At no time shall any yard sale be permitted to operate if, in the judgment of the Town Manager, or his designee, such operation generates noise, traffic, or other nuisance detrimental to the public health, safety, or welfare of the surrounding neighbors or the community.

4.    Yard sales shall be conducted only during hours beginning one-half (1/2) hour after daylight until one-half (1/2) hour after sunset.

5.    All yard sale merchandise as well as all tables, stands, and other displays shall be removed from public view at the conclusion of each yard sale period.

6.    No more than three (3) off-site temporary signs may be used. Signs shall not be placed so as to obstruct sight lines or create traffic hazards, obscure traffic signage, or obscure permanently placed business signage. Yard sale signs shall not be affixed to any utility pole, traffic sign, or other similar structure. Every sign shall display the name and address of the party(s) responsible for the yard sale. Yard sale signs shall be removed within two (2) hours of the end of the yard sale. (Ord. 06-276)
