RESTRICTED PARKING IN FIRE ZONES

10.08.010 Definition and designation of fire zones.

A.    A Fire District, with notice to the Chief of Police, may request or require that a public or private property owner establish fire zones on their property where the health, safety and welfare of the public requires it.

B.    An owner of public or private property may, with the prior written approval of the applicable Fire District and the Chief of Police, erect on their property a standard sign(s) and paint a curb or boundary area red to create a fire zone.

C.    Fire Zones shall be marked with a red painted curb or boundary area and a standard fire zone sign. The Town shall make the standard signs available at a reasonable cost. The cost of painting and signing fire zones shall be solely that of the owner or possessor of the real property. Likewise, maintenance of fire zones shall be the sole responsibility of the owner or possessor of the real property.

D.    No person shall park, stop or leave standing a vehicle in an area or space set aside and identified by painting and signage as a fire zone.

10.08.020 Town enforcement.

A.    An owner of public or private property who has created a fire zone appoints and authorizes the Town as the agent of the owner and impliedly authorizes the full enforcement by the Town of the fire zone parking restriction on that property.

B.    A law enforcement officer, police aid or parking enforcement specialist employed or authorized by the Town who finds a motor vehicle which is not an authorized emergency vehicle parked, stopped or standing, whether occupied of unoccupied, in an area designated as a fire zone may issue a civil complaint to the operator, owner or other person in charge of the motor vehicle, or place a notice of violation on the vehicle, as appropriate.

C.    A law enforcement officer, police aid or parking enforcement specialist employed or authorized by the Town who finds a motor vehicle which is not an authorized emergency vehicle parked, stopped or standing, and unoccupied, in an area designated as a fire zone may request that the motor vehicle be towed away at the owner’s expense, in addition to any other civil sanctions authorized by this Chapter. All towing shall be accomplished by a private towing carrier approved by the Chief of Police.

10.08.030 Violation - penalty.

A.    Any person found guilty of violating any provision of this Chapter shall be guilty of a civil traffic violation as provided in A.R.S., Title 28, Chapter 6.

B.    Any person found guilty of violating any provision of this Chapter shall be subject to a civil sanction which shall not exceed sixty dollars ($60.00). (Ord. 00-178, §§ 1 and 2).

C.    Civil sanctions, if any, shall be levied in addition to any towing costs which result from the towing of a vehicle pursuant to this Chapter.
