15.20.010 Building Alarm User Permits

A.    Every building alarm system user (residential or commercial) shall obtain an alarm users permit from the Pinetop-Lakeside Police Department/Planning and Zoning Department for each building alarm system. Such permit shall be obtained within six (6) months from the effective date of this Chapter, and prior to the use of any building alarm system which is installed or repaired after the effective date of this Chapter.

B.    The building alarm users permit shall be physically displayed or readily available within the premises using the building alarm system and shall be available for inspection by the Police Department or the Planning and Zoning Department upon request.

C.    Permits may not be transferred from one user to another or from one address to another. (Ord. 99-171)

15.20.020 Permit Fees; User Service Calls Fees.

A.    The fee for building alarm permits shall be established by resolution adopted from time-to-time by the Town Council. The initial permit fee shall be twenty-five dollars ($25.00) per year for all permit applicants, and there shall be no fee for permits issued to residential property owners over 65 years of age, who actually reside at the residence where the alarm is located.

B.    The alarm user permit fee will include the first three (3) user service calls for police response to alarms or false holdup alarms or false fire alarms. Alarms users will be billed an alarm service user fee for each alarm responded to by police after the first three (3) responses to alarms. User fee charges shall be established by resolution adopted from time-to-time by the Town Council. Failure to pay user service fees within thirty (30) days of being billed for same shall subject a person to the civil penalty provided by Section 15.20.070, below. 15.20.030 Alarm System Receivers.

The building alarm system receivers which are currently installed within the Pinetop-Lakeside Police Department communications center shall be removed within one (1) year of the effective date of this Chapter. No building alarm system receivers may be placed or installed at the Town Police Department without the express written approval of the Chief of Police. This subsection does not apply to government building alarm systems. (Ord. 99-171)

15.20.040 False Alarms.

Any building alarm system which has more than three (3) false alarms which are responded to by law enforcement officers, within one permit year shall be subject to fees for police response services as established by resolution adopted from time-to-time by the Town Council an any building alarm system which has twenty (20) false alarms or more within one permit year may be subject to permit revocation and/or required repairs to the building alarm system as hereafter provided. 15.20.050 Required Repairs; Revocation of Permit.

If the Pinetop-Lakeside Police Department records police response to twenty (20) or more false alarms within one permit year for any building alarm system, the Police Department may notify the alarm user by certified mail or personal service of such fact and may direct that the alarm user submit a report or repair order to the Chief of Police describing the actions taken or to be taken to discover and eliminate the cause of the false alarms. If no report is submitted to the Chief of Police as requested, or if the Chief of Police determines that actions taken or to be taken by the alarm user will not prevent the recurrence of false alarms or noncompliance of the Alarm Ordinance, the Chief of Police may give notice by certified mail or personal service to the alarm user of a permit revocation hearing to be held by the Pinetop-Lakeside Town Manager or a Hearing Officer appointed by the Town Manager. The Hearing Officer will determine whether to suspend, revoke or reinstate the alarm user’s permit. The hearing should be held within thirty (30) days after a request for hearing and the Hearing Officer shall render a decision within ten (10) days of the hearing. (Ord. 99-171)

15.20.060 Notice of Suspension or Revocation of Permit.

An alarm user whose permit has been suspended or revoked shall be furnished written notification of such suspension or revocation and shall, within three (3) days after the furnishing of such written notification, discontinue the use of any building alarm system(s) for which a permit has been suspended or revoked. 15.20.070 Unlawful Use; Civil Penalty

A.    It shall be unlawful for any building alarm user to activate or otherwise put in use a building alarm system within the Town of Pinetop-Lakeside without first obtaining an alarm user’s permit as required by Section 15.20.010, above.

B.    It shall be unlawful for any alarm user to fail to disconnect the building alarm system within three (3) days after written notification has been furnished advising the alarm user of the suspension or revocation of the alarm user permit.

C.    Violation of any section in this Chapter shall subject the violator to a civil penalty in accordance with Chapter 17.132 of the Town Code, as if set forth fully herein. (Ord. 99-171 § 1)
